Timothy Alan Puis, who lived on Joe Sanchez Road, was westbound on Sydney Road in Dover when his car apparently veered into a ditch. Rep. Harold Spaet says the drug he takes for epilepsy and his insomnia problems give people the wrong idea. TALLAHASSEE (UPI) Florida House Speaker Lee Moffitt has asked two senior legislators and a top aide to probe rumors of drug abuse by state Rep. Harold "Hal" W. Spaet, D-Miami Beach, it was reported Saturday.

Spaet, who has served in the House for five years, denied he used illegal drugs. "I have never taken drugs," he said in a report by The Orlando Sentinel. On Thursday, Moffitt asked Reps. Carl Ogden, D-Jacksonville, and Sid Martin, D-Hawthorne, to go to Miami Beach and report back to him on whether Spaet, 39, has a drug problem. Spaet, an epileptic for at least seven years, said the effects of his epilepsy medicine, Dilantin, and lifelong insomnia problems have given people the wrong impression.

"It's very difficult to explain to people that the Dilantin effect and the insomnia and have them believe it," said Spaet, a lawyer who lists his hobbies as tennis, football and ra-quetball. Moffitt ordered former assistant highway patrol major Karl Adams to help Ogden and Martin investigate Spaet. "I want to know the facts," Moffitt said. "I hear the same rumors you hear. I want to find out if he is a victim of rumor or it's his epilepsy medicine." Moffitt said he chose Ogden because he is the former chairman of the Ethics Committee.

He said current chairman Ron Silver, D-North Miami Beach, was kept out of the probe because he and Spaet both represent Dade County. Mark Herron, House executive director, said the investigation will take two to three days. He said the lawmakers will talk to members of the Dade delegation, Spaet's friends and law enforcement officials. Moffitt said if the investigation reveals a problem, he will ask Spaet to enter a drug rehabilitation center. The House speaker said he called for the investigation after he learned a 33-year-old women staying in Spaet's apartment suffered an apparent drug overdose, The Sentinel reported.

Spaet said he allowed the woman, a longtime friend, to stay with him because she had a 3-year-old son and needed shelter. He said after putting the child to bed, the woman fell asleep in his bed. He said he was unable to wake her several hours later and called the rescue department. Officials said paramedics were summoned to Spaet's apartment on Sept. 16 and again on Sept 18.

He said both incidents were listed as possible drug overdoses. Documents provided to The Sentinel by Spaet include a letter from physician Joel Dokson saying Spaet has had "an ideopathic seizure disorder" since 1976. The cause is not known but is consistent with an epilepsy diagnosis. Dokson said Spaet was taking up to 6 Dilantin tablets a day almost double the recommended dosage and he advised the lawmaker more than a month ago to cut down to three capusules daily. Spaet said he was taking the proper amount for his weight at one time, but since had slimmed down, i Dilantin can make users appear drunk if taken in abnormally high amounts.

Symptoms include an, unsteady walk, blurred vision and gum overgrowth. The rumors that Spaet abused drugs were fueled by two incidents in the past 18 months. In April 1982, he had an apparent seizure on the House floor in the closing moments of the legislative session. A neuro-suregeon said there was no evidence drugs were involved, although rio tests were performed. In March, Spaet was driving on Miami Beach and struck two pedestrians on a street corner, critically injuring one.
