Shamblen agreed to raise corn for Shugart at cents a bushel province! it was plowed four times during its he was to receive but (if cents, or one-fourth per bushel less. In a recent attempt at Settlement Shugart desired to settle on a basis of cents, but Shamblen dis-e Hence the suit. The controversy was over the difference between the price of the corn at (if and at nine cents per bushel.

On his part Shamblen contended he had plowed the corn three times, but that owing to the lay of the land his landlord did not wish him to go over it a fourth time as it would by so doing caus-e the.field to be badly washed. This statement Shugnrt denied and pointed to a clause in the lease that stated that all deviations therefrom mustrbe in writing, and that such an agreement, if at all, was mado orally, Green in his instructions to the jury practically settled the matter, lelling the twelve men to base theii verdict on a reasonable rather than a rigid construction of the contract. One or two other things were in dU- pute, but the question for the jury to nettle was, the price of th: corn. Several weeks ago a suit of ejectment was fought out in Justice VanDoiv.n's court at Strahan whun an obstacle was encountered in the way of a contradictory clause in the contract, ivhich ft.ited that Shamblen was to occupy the premises from March until Dec. 1st, or, until the crop was hir- vested.

The big snow storm in November prevented the corn bjing gathered by Dec. 1st. sto that under the contract the tenant could not be ousted, a point that Judge Green also made use of. After a short deliberation the jury returned a verdict for Shamblen, throwing the costs onto defendant, which must have been close to $200 with all the witnesses and other expenses in. Messrs.
