The following abstract of the opinion of tbe Supreme Court of Illinois, just filed at Ottawa in tbe im-nortant case of the Citr ot Golesbunz vs. Olof Hankia- found of much interest to municipalities and property-owners all over the State: This case involved the eonitrvetion, tftet, and validity of the provisions of the act of April 10, A. D. 1872, 'entitled an act to provide for annexing and excluding territory to an from cities, towns, and villages, and to unite cities, towns, and villages." The suit was instituted under the provisions of the act referred to by certain -persons, being legal voters and owners of land lying within the corporate limits of tne city of Galesburg, by a to the Circuit Court of Knox County, in accordance with the provisions ef the act, praying for -a disconnection of tbe lands of the petitioners from' the territory comprised within the corporate limits of the city.

Tbe city ot Galesburg, by its counsel, appeared at the hearing, in obedience to the notice required by tbe law to be published in such cases, and resisted tbe application, among other things nnon the ground that as the city owed a bonded debt of $90,000, the withdrawal of large portion of the territory of the city liable to taxation for the payment of this debt would be a pal pable violation of the provisions of the State Constitution, requiring taxation to be uniform, and requiring also that all the taxable property witbiu tbe lim its ot a municipal corporation snouia oe taxea to pay its debts, and would operate as a great injustice upon the owners of real estate and tai-payers in the city, whose eal, estate should remain within Its limits after tbe proposed disconnection should take place, and also upon tbe ground that the rights of creditors and the owners of the bonds would be injuriously affected, and tbe obligation of their contracts impaired, in violation of tbe Constitution of tbe United Stater, by Riving unconditional enect to the statute in question and by granting the prayer of the petitioners. Upon appeal to the Supreme Court, by the city of Galesburg, tbe same objections were urged against the decree oi the court, and a ground -for a reversal of the same.

A t. TBI fCIBKMICOCBT reversed the decree of the Circuit Court, and held the provisions of the act under which the proceeding wst bad to be in violation of tbe Constitution of this Stale, nod void. Inumnch as all taxable property property within tbe limits oi such rooraUons our Constitution, be taxed on tbe be oi uniformity as to persons and property fur the payment of municipal in debtednea, it is plain that the withdrawal of any real -state from the Jurisdiction of such taxation where a given sum is to be rained, to tnat extent increases the burden of taxation on the property remaining within the corrjorale limits. Considering that all corporate ln- debtedneas is presumably incurred for tbe equal benefit i every part of the municipality, tbis is la ltreif an injustice to the remaining tax-payers, unless the act of disconnect ing tbe property attended with some corresponding benefit to the municipality.

It we were to give effect to the statute, its language could not be disregarded. Beiua in deromttion of the common law. it should be construed strictly, and the city and others nitcut properly insist mat notntng snouia interested be taken nest. lntents I ment merely. The verdict of the jury would tnerefore seem to be entirely Insufficient to warrant the decree which was rendered.

The statute is susceptible of no otber construction, thin that the court or jury trying the ease shall tlnd whether the territory ought to be disconnected, and if so whether it can be done without any Injustice to the inhabitants or per-ons interested therein. This verdict determines nothing in this respect. It is for the petitioners and nothing more. We do not think this was comprehensive enough to justify the decree. But we conceive that the proceeding is liable to a still graver objection.

By article of our constitution tne powers of tbe government of this btate are divided into three distinct departments the legislative, executive, and judicial, and no person nor collection of persons being one of these departments shall exercise any power properly belonging to either of the other, except at thereinafter exptessly directed or permitted. a The boundaries of the city of Vale-burg are defined by Its charter and amendments thereto, and any change In those boundaries must necessarily contract or enlarge tbe sphere ot Its munirl pa juri-diction, and therefore constitute so far an amendment of its charter. That the Legislature may delegate authority to a municipal corporation to make changes In lis boundaries does not affect tbe principle. a e. a a The attempt here is to invert the Judiciary with power not mereiy to determine whether certain prescribed conditions upon which the law is to take effect exist, but whether as to a certain locality there ought to be a change iu tbe existing law on a particular subject and if, in the opinion of the court, the change ought to be made and injustice will not be done thereby, it is empowered to make it a a a Whether cities, towns, or villaees should be Incornorated.

and, if incorporated, whether enlarged or contracted In their boundaries, presents no question of law or fact for judicial determination. It is purely a question of policy to be determined by the legislative deparunent. e. If the bqindarles municipal corporations can be altt red and changed by the Legislature in its discretion, and the authorities are all that way, then it is impossible fiat the courts can be invented with such power. Courts mav determine what are the corporate limits already established; they may determine whether what is claimed by the municipal authority to be the corporate limits is so or not, aud they may inquire whether tbe legislative authority has exceeded the powers with which it is invented bus all this implies an existing law applicable to the particular subject, and the inquiry is, what is the law, and has it been 'violated or complied with? Here, however, the inquiry Is, what I shall the law be as respects the boundaries of this city? shall It be as designated by the charter, or shall it be as prayea oy tne petitioners! Ana tne aecree ot tne court is the answer: That decree assumes to be not a declaration of rtghta nnder the law, but the law itself, amending and changing a previous statute as to the extent of territory over which a particular municipal government shall obtain.

This decision, therefore, it will te seen, holding virtually as it does that this act of 1872, bo far as ft authorizes the annexation of territory to, or its disconnection from, cities and towns by the intervention of iurT, is in violation of tbe constitution and void, becomes a matter of general public interest and assume au imoortance far beyond the mere local Interests directly involved in tbe case decided by the court. I Mr. Hancock afterwards filed a supplemental report in which he sets out that be has received a bid from J.
