Sack, 73, of Michigan City, assistant secretary and treasurer for the South Shore Railroad, died Friday in Cleveland. Survivors include his wife, the former Rosemary Weiler, formerly of Valparaiso. Merrell, 62, a Hobart resident 32 years, died Friday In Porter Memorial Hospital, Valparaiso. He was employed 17 years as an operating engineer for Hunter Construction Co. at Bethlehem Steel Corp. and was a member of Operating Engineers Local 150. He was a member of M.L.

McClelland Masonic Lodge 357 Hobart; past high priest royal arch, Gary Council 103, Gary Commandry 57; past patron of Hobart Order of Eastern Star Chapter 314; and past DeMolay Dad. He was a World War II veteran. Surviving are his wife, Joyce; two sons, John of Portage and James of Tennessee; a daughter, Karen Raymond of Valparaiso; a brother, Raymond of Galveston; two sisters, Margaret Pedersen of Michigan and Nora Eskridge of Knox; and two grandchildren. Orr received at least $1,300 worth of gifts last year from organizations with financial interests to promote with the state. His partner in government, Lt. Gov.

John M. Mutz, received at least $700 in gifts from individuals and entities with similar interests. There's nothing illegal about the, gifts, so long as they are disclosed in annual economic interest statements which must be filed with the State Ethics and Conflict of Interest Commission. And even if the gifts weren't disclosed, there's really no way to find out if there were any omissions. That's because the Ethics Commission whose members are appointed by the governor doesn't audit the annual filings.

The 1974 ethics law which requires the reports contains no penalty for lying about an official's financial interests. Nor is there a penalty for failing to file the report. The reports are required to be filed by the governor, lieutenant governor, secretary of state, auditor, treasurer, attorney general and state superintendent of public instruction. The law requires these of- from the Indiana State Fair Board (admission tickets, use of a demonstrator car and a board member uniform of slacks and a jacket); the Indiana Republican State Committee (transportation and expenses at party functions); Indiana University, Purdue University, Hanover College, the U.S. Clay Court Association and the Indiana High School Athletic Association (tickets to athletic events) and the Indianapolis Motor Speedway (four tickets to the 500-mile race).

Other gifts were tickets to the Indianapolis Symphony and Starlight Theater, a movie pass from the Indiana Theater Owners and transportation from the Vanderburgh County Republican Committee and Dura-Container Corp. The governor and his wife, Josie, reported owning at least $170,000 worth of stock in 14 corporations. The exact value of their stockholdings need not be listed. The corporations included Emery Air Freight, Georgia Pacific IBM Citizens National Bank, Old National Bank, Ball Corp. and Great Lakes Chemical Corp.

Mutz' real estate holdings consist of homes in Indianapolis and Columbus and a farm in Bartholomew County. Mutz is a member of six partnerships, three of which own Burger Chefs in Indiana and Kentucky. The others are Involved in cable television, a shopping center and oil wells. The lieutenant governor also serves as an officer or director in five corporations, including Fast Food Management Circle Financial Corp. and Sargent Greenleaf, a Kentucky-based lock manufacturer Mutz, his wife, Carolyn, and their children own at least $100,000 worth of stock in eight corporations. They include Merchants National American Fletcher Louisville Gas Electric Standard Oil of California and Indianapolis Water Co.

None of the other officials required to file ethics disclosures reported- receiving gifts. Only one, Treasurer Julian L. Rid-len, reported owning than $10,000 worth of stock in a company known as Came-lot Investments, Inc. Springs Road, Porter. Sealed bids will be accepted until 1 p.m.

The public's record ficers to report gifts worth more than $100; the location of real estate worth more than employers outside of state government; business interests; corporations in which the official or spouse is an officer or a director; and stockholdings of at least $10,000 in any one corporation. Orr reported owning condominiums in Evansville, Indianapolis and Vail, and a one-third interest in a farm near Osceola, Mo. The governor serves as a director of the National Rail Passenger better known as Amtrak, and Dixson, a manufacturer of instruments and quartz.

He also is a trustee of Hanover College in Hanover and of the Willard Library in Evansville. Orr reported receiving gifts samples of the finished product to taste. The association, formed last fall for goat-owners or others interested in goats, has members in Lake, Porter, Jasper and LaPorte counties, and publishes the Dairy Goat Newsletter.
