a a 1 1 0 0 0 RECORD OF THE COURTS. Judge Kohlsaat Takes Up Another Day McMahon Poisening Case. Will of Jerusha Hooker Makes Several Charitable Bequests in Distributing 8100,000. Divorce Matters-Sturges' Big Claim Itemized-Alleged Fraudulent Land Deal. BITTER FEELINGS.

The McMahon chili poisoning case before Judge Kohlsaat is assuming the shape of right between Edward McMahon and his wife on one side and Peter Smith, the millionaire, on the other. The question of whether Ed McMahon administered paris green to Milton was dropped for a while to discuss the gener, I conduct of Ed and to examine Mr. Smith relative to the financial condition of the estate. Lieutenant Barcal, of the East Chicago Avenue Station, said he was called to the St. Vincent's Home on LaSalle street and was told that Ed was insisting on taking his child out of the institution without an order of court.

Witness told him he would have to keep still or he would arrest him. Ed was a little under the influence of liquor at the time. On cross-examination Mr. Smith was why he had paid $900 to Ed's mother for the support of the minor, contrary to the ordor of court, and when seeking to recover his child by habeas corpus before Judge Collins. He denied that he did and said he paid the money by direction of court, and charged it to the minor's estate.

Witness paid 964 to detectives to locate young Milton. Judge Wing sought to show that Smith well knew the whereabouts of the child and that the detectives were ployed to watch Ed and his wife. Witness denied that such was a fact. Some time ago Judge Kohlsaat received a letter purporting to come from a disinterested person. It stated that Milton was being m18- treated at the home of Ed and his wife and that the Humane Society would investigate unless the court interferred.

Mr. Smith was asked if he knew in whose handwriting the letter was, and he replied that resembled that of his wife, Kate Smith, whom Mrs. Ed McMahon is suing for $100,000 damages for slander. Dan Coleman, husband of Rose Coleman, with whom Ed and his son Milton were boarding at No. 2885 Archer avenue, was called.

He said that Ed left the house owing do board bill and Ed had borrowed money from him and others. Witness corroborated the testimony of his wife relative to statements by physicians and others that Ed had poisoned his son. Further proof will be taken to-day. FAMILY QUARRELS. Judge Tuley has on hearing the separate maintenance 'suit of Mrs.

Helen A. Miller against Charles J. Miller, the well-known agent for a liquor firm. Mr. and Mrs.

Miller were married May 16, 1867, and have two children. The wife resides with her parents in Philadelphia, and in her deposition, read yestorday, she testifies that she was obliged to leave him Nov. 4, 1887, on account of cruelty, and she also alleges infidelity. In her bill she claims that Miller i is receiving an income of over $5,000 a year. Miller has cross-bill on in which he accuses his wife of deserting him over two years ago.

He claims that his wife has been interfering with his business by writing improper letters to firms he represents. Before Judge Shepard, Charles S. Albee is seeking a divorce from Mary W. Albee, to whom he WAS married in 1885 at Bellows Falls, Vt. He deciares that she left him in 1889.

Mrs. Albee denies his charge, and is trying to prove that he deserted her. Albee is a young man, and the son of a wealthy farmer in in Vermont. Mrs. Albee keeps a millinery establishment in Lawrence, Mass.

CHARITABLE BEQUESTS. The will of the late Jerusha N. Hooker, admitted yesterday, distributes an estate valued $100,000. Letters testamenarv were issued to Frances Elizabeth Ely, of No. 1921 Indiana avenue, in bond of $12,000.

The following bequests are made: Frances M. Jones, Robert R. Northum, Sarah Elizabeth, and Frances Goodhue, each $200; Catherine M. Usher, $200; Woman's Presbyterian Board of Missions of the Northwest, $500; Board of Home Missions of the Presbyterian Church, $500; and the residue of the estate to Frances Elizabeth Brust Ely. WILLIAM STURGES' BIG CLAIM.

A bill of particulars in the big suit of William Sturgos against the Farwells and Congreseman Ab Taylor was fled in the United States Court yesterday. Sturges claims something near $1,000,000 compensation for engineering the big deal whereby the syndicate headed by the Farwells floated a big loan on their Texas land grant given them for erecting the Texas State House. Sturges claims that, at the solicitation the syndicate, he went to England in June, 1884, and remained there almost constantly until 1889, during which time he raised $5,000,000, formed a company called the Capital Freehold Land and Investment Company, with a capital stock of $10,000,000. During these years the plaintiff claims to have saved the syndicate $4,000,000 and expended $60,000. CLAIMING FRAUD.

In a Circuit Court bill Mrs. Eunice A. Pom- eroy charges Thomas B. Kinney, real estate dealer, and George H. Welton with fraudulently inducing her to sell sixty acres of land at $30 per acre when it was worth $100 an acre.

Complainant resided in Mascoutah, and appointed Kinney, of Kansas City, to sell the land at the best price obtainable. Kinney employed Welton and the latter is accused of representing that the land was worth only $30 an acre when he knew better. As a result of such statements Mrs. Pomeroy executed a deed to Welton's wife. She now wants it canceled because of the alleged fraud practiced.

MUST PAY $3,000. Judge MoConnell? jury yesterday ordered the North Chicago Street Railway Company to pay $3,000 for the privileges Conductor John A. Smith took in beating Teamster Henry Letto. Letto was ordered out of the North Haifted street tracks: in August, 1888, and Smith said lie began using his whip on the passengers. The conductor seized the switch book and gave Letto a beating.

He died from the effects of the encounter. His widow, Sophia, sued for $5,000 and won her case. The company tried to justify Smith's action on the ground that he was protecting pas- BRIEFS. Mrs. Annie Baier is suing George Richman for $2,000 for the loss of her teeth and the pain incident thereto. Easter Sunday she was driving toward funeral Graceland when a carriage belonging to a procession collided with her buggy. She was thrown to the ground and her teeth were knocked out. She says the drivers was drunk, and began suit against Richman, his employer.

Bernard zachorowsky is trying to hold the capitaliste interested in the old hicago Driving Park to account for a $4,000 indebtednees. He obtained judgment againat the park corporation for that amount in 1885, and represents that it is still unsatided. Ho believes that T. 8. Robinson, A.

Collins yesterday authorized Thomas Parker, u. receiver of the Mutual Fire Insurance Company, to settle 8 claim against the Canton Mutual Fire Insurance Company, which failed in May, 1889, owing the insurance company of this State $4,432.38, on which 85 per cent has been paid. A receiver for the Ohio concern is willing to compromise for $1,000, and the Court allowed Mr. Parker to do so. Arthur B.

Webb came into the County Court in A charge of his friends yesterday and was adjudged insane. He will be sent to Kankakee in a day or two. Mr. been connected with Marshall Field's wholesale house for nearly twenty-five years and has held very responsible positions. Recently his health began to fail, and overwork and close confinement BOOn affected his mind.
