July 11 tf A Civil Aeronautics examiner today set the stage for determining the need for three trunkline air carriers on the New York-Florida route. The case, tentatively set for hearing in mid-December, involves an application by Northeast Airlines for renewal of its New York-Florida permit, which expires Nov. 27, and possible merger of Northeast with another major airline. Examiner Walter W. Bryan said at a prehearing conference that the hearing should be confined to: 1.

Whether three carriers are necessary between New York and Florida. 2. Whether Northeast's certificate should be renewed in whole or in part and, if so, is Northeast able to supply the service. 3. If Northeast's certificate is renewed, would merger with another airline be in the public interest.

Brings Opposition This met immediate opposition from New England interests who want the CAB to look into Northeast's service in that area. Bryan and Henry Foley, Northeast's attorney, agreed that passengers generated in New England for the New York-Florida route would be a favor in the case. But Bryan said New England regional service should be considered in a separate hearing later. The examiner said that point would be ruled on by the board itself when it issues its order listing participants in the formal hearing. The CAB in 1956 authorized Northeast to extend its New IfV.
