Patron Wins Damages In Dressing Row (Continued 1 from Page 1) was staying, Menendez followed and struck him on the head with the ash tray after he cursed the waiter. An assault and battery charge which Petty brought against Menendez, a waiter for 15 years, was thrown out of Justice of the Peace Court by Judge W. Marion Hendry who observed: "If he'd called me that, I'd have hit him with an ash tray, too." "In the construction business we use that term all the time," Petty said on the witness stand yesterday. "We don't mean anything by it. It's just a figure of speech for us." Petty said he left the restaurant "to avoid arguing with the waiter." He said he suffered from hypertension and high blood pressure and planned to do whatever the manager of the motel told him to do about the check and the extra charge.

Attorney John S. Matthews, representing the waiter and the restaurant, asked Petty: "If you wanted to avoid an emotional scene, you could have simply paid the 35 cents, couldn't you?" "Principle Involved" said Petty. "But there was a principle involved there, Mr. Both Petty and the waiter took the stand to testify about the "ungentlemanly conduct" of the other and each offered several additional witnesses to back up their stories. Petty said he had drunk five beers in the restaurant's bar between noon, when he was supposed to meet a customer, and 3 p.m.

Menendez testified he had already struck off the extra charge for the Roquefort dressing and was simply waiting until Petty stopped "his loud talk and profanity" to tell him. Before he could tell him. the waiter testified, Petty said he would "leave it up to the manager (of the motel)." "Three Tables Away" "But," said Menendez, "the manager of the motel was tables away time." actually sitting, just three The motel and restaurant, although owned by different corporations, have an arrangement so that patrons of the motel can sign for their restaurant bill and pay for it when they check out.

When he arrived at the motel office and was beginning to explain the situation to the clerk on duty, according to Petty, the waiter burst in, came over to the desk, flipped the check at the clerk and said: "Put this thing on his account." It was then, according to testimony, that Petty said with an open-handed "Get out wave of of here his and hand: leave me alone, you stupid, little Hit With Tray When Petty turned back to the counter, the waiter picked up a five-inch square green glass ash creased Petty's head tray, with at the and, base of his skull. Petty said waiter partially took off his jacket when they both left the dining room on their way to the motel office and when they had their final encounter in the motel office.

"Balled His Fist" Menendez, however, denied he offered to "fight it out" and said he conked the salesman with the ashtray only after the salesman "balled his fist at me." "I kept my temper as as I could," the waiter said, "and I even offered to pay for the Roquefort dressing myself. But I couldn't keep taking his abuse." Thomas Clark, who represented Petty, asked the jury to bring in damages of $7,500. The six-man jury deliberated 50 minutes. Judge Oliver C. Maxwell presided.
