The founder might, if he pleased, establish a speeial order of succession deristing from this regular order but "the presumption of Maltese law, when a contrary intention was not reasonably clear, was in favour of the regular order. It was argued on behalf of the appellant that an Intention on the part oi the founders of this particular prtwotfm.i'ura to deviate from the regular order, so aa to give mala collaterals of a younger line the preference over daughters of any holder in an elder line dying without male issue, was sufficiently made out. Their Lordships, after fully considering the argument addressed to them, were unable to accept that conclusion. Thry thought the natural construction of the written instrument in this ease, even if it were not aided by tha ordinary presumption of law, would be in the respondent's favour. Raving referred in some detail to the terms of the instrument, the Earl of Bel borne said their Lordships would humbly advise ber Majesty to affirm the judgment appealed from, and to dismiss tbe appeal, with costs.

This was an appeal from a decision of Mr. Justice Stirling, reported in 7, Tie Tinui Law Reports, 694. It raised a question tinder the Lands Clauses Act, 1813, of considerable importance as to the compensa tion to be awarded to the lord of the manor when copyhold lands are taken by a railway" company for the purposes of their undertaking. The action was brought by the lord of the manors of West Linton and iS tain ton, in the county of Cumberland, In order to recover payment from the defendant company of a sum of 980 determined by an arbitrator to be the compensation payable under section 96 of the Lands uiauses Act, ihj, to tne piaintin in respect of tee enfranchisement of certain copyhold lands, formerly held of the manors and taken by tbe defendant company for the purposes of their undertaking, for the loss In respect of the rents, fines, dues, duties, and services or any other matters occasioned by the enfranchisement. The defence was that the compensation awarded was assessed on a wrong basts.

At tbe trial the arbitrator was called and questions were raised as to the admissibility ot his evidence or of portions of it but an arrangement was subsequently come to between the parties that tbe Court should decide the question between them as if it had been raised on a speeial case stated by the arbitrator. Tbe facts which gave rise to the dispute were these. In 1873 the defendants, in exercise of cowers conferred on them bv an Act of Parliament (35 and 36 e. 114), with which was incorporated tbe Lands Clauses Uonsolidation Acts, 1845, 18C0, and 1867, took possession of the copyhold lands in question arid proceeded to erect thereon 16 cottage and to construct a reservoir and other works for the purposes of their undertaking. Conveyances to the defendant company of the lands were executed on November 4, 187S, and were enrolled in the Court Rolls of the manors on the 16th of the same month.

No step having been taken by the defendant company to procure the lands' to be enfranchised pursuant to section t'C of the Lands Clauses Act, 1845, the plaintiff by a notice in writing under his hand dated December 30, 1886, and delivered to and received by the defendant company on January 15, 1837, required the eomnaQT to enfranchise the said lands aod to tnv him tbe compensation in respect of the same and of the rents, toe, dues, duties, suits, boons, and services tneretor due ana 01 rignt accustomed, and in respect of his interest in the said lands and the plaintiff thereby gave notice that the amount of his claim by reason of the premisses was 1,500, and, unless the eompany were willing to pay that sum, and should enter into a written agreement for that purpose within 21 days after receipt of the notice, it was his desire that the amount to be paid to him by reason of the premisses should be ascertained by arbitration according to the provisions ot the Acts of Psrliament in that behalf. Mr. Saul made his award, dated December 31, 1883, and thereby awarded and, determined that the compensation to be paid by the company to the plaintiff in respect of the taking' and enfranchisement of tbe lands in question, and for the loss in respect of the rents, fines, dues, duties, and services or any other matters occasioned by tha enfranchisement of the same, shoal be the emn of 980. In the manors of West Linton the customs are of a peculiar nature, and under them. according to low sthucs ut atr. osai, an axDitrary fine of two years' improved value payable on the death either of lord or tenant, and an arbitrary fine of three years' improved valne on alienation.

In, the manor of Stainton the fines are fixed and the question as regards the compensation payable in respect of the copyhold held of that manor was of very little importance.
