Bat the'judge can only be excused by the blame being transferred to the modern system of procedure, which has set aside all the rule of pleading, by 'which the issue between the parties ought to 1 clearly ascertained before the hearing, and ha rendered it possible that the parties themselves, their counsel, and th judge should all be in the dark as to th question at issue till th last moment, when, after a prodigal wte of time, word, and money, the reply of the last counsel disclose that there is no question at all at issue between the perti. There wa a high court at Athens, which heard and determined all cause at night and in th dark, that th judge might not be biassed or influenced by th light of th parties. It ha been reserved for th inventive genius of the. 19th century to construct a court wherein the partiee themselves and thsir counsel shall be bliidfolded and where the judge shall sit in broad daylight, bat in a state of mental darkness, nnabl to ascertain tb question ahich is to decide, until hi decision is not required by the discovery that there is no question in dispute before him.
