Judge Anthony has been engaged for eev-eral days In the trial of the condemnation ait ot the Chicago, Eranatoa and Lake 8u-perior Ballroad Company against the Charles Xliets Lumber Company. The railroad oom-psnysoaght to oonaemn a large tract of property west of the Chicago River, lying between the rtver and Canal. Randolph, and Lake streets, and la owned and occupied by the Eietx Company as a lumber yard.

The railroad company proooeea to build a depot on the site, but could effect no acreement aa to price with the Bieta Company, which demanded $400,000. while the railroad company was only willing to pay $250,000. for the land actually needed and to be occupied. The lumber company claimed that If Its yards were taken tne docks which it owna would be rendered valueless. The railroad company has no use for the docks and Its offer did not contemplate them.

The lumber company. Howard, allowed so conclusively by evidence at the trial that Its docks would be rendered useless that the railroad company, fearing that It would have to pay for the oocks also, aaaed and obtained leave yesterday to amend tneur petition so as to Include the docks in their suit. Pitcher, the expelled member of the Board of Trade, for a mandamna to compel the directors of the board to reinstate him. fie again protests bis innocence of the charges preferred against him by Boylaton Hall and says, in addition, that his expulsion was altogether illegal.

Tha rules require that at least twelve of the board who -neve heard the charges shall vote for expulsion. A number of the twelve who did vote for bia suspension had not heard the evidence at all The testimony taken waa not under oath and was hence 11 local. As the expulsion prevents bis selling his membership, valued at $10,000, he claims that his property is conn seated on evidence unsupported by oath, which is contrary to the constitution and statutes of the btate. Two of tne twelve directors who voted against him were James H. Milne and W.

Creesner waa held yesterday morning at the East Chicago Avenue Btatton by Deputy Coroner Barrett The prisoner. who is a very small and a very thin man aad does not weigh much over a hundred pounds, waa very pale aa ha aat liatening to the testimony. The first witness called waa Mra Annie a midwife. She testified that the accused came to her bouse, late la the afternoon laat Sunday, and said that bia wife would be oon- fined In a week or two.
