In ruling against Tunstall, Judge Stevens said: 'It was admitted on an agreed state of facts that by reason of a contract between Matthews and tha tax-collector Matthews thought his taxes were paid, and was, therefore, excusable under the law for not attempting further to pay them. The New York Mail and Express has gone into ecstacies over the fact that the Ahibama Legislature has passed a bill exempting cotton factories from taxation for a term of ten years, and predicting that on this account an era of fac tory building and prosperity is going to dawn on that State.

Mississippi has had a similar law for some time, one which exempts not only cotton, but all other factories making a finished article, for ten years, but if it has influenced the establishment of a single mill, the an uonncement has not hesn made public. However, the State loses nothing by this generosity, whether the factories are built or not, and so long as the ex etnption stands it is evidence conclusive that our law makers appreciate the benefits of such enterprises. Physician and Other Testify lliat Stewart Was Poisoned. A t) the Meridian News from Derl.il duel March 11, says: Contrary to general expectation, a jury was secured in the Lipscomb poitoning now on trial before Jude Hud-dlnstou at th place by noon today. Shetii Carter, assured by an able force cf deputies, was busy scouring the county yesterday afternoon, lat night and this morning, and as a result of their labor men were riding iuto this little l'age by twos and threes, answering the summons of the court from noou until a late hour this morning. Court opened at 9 o'clock and after threo hours of hard work, the panel was filled and both the State and tha defense answered satisfiedjwith the jury, who will deteiuiine by the evidence in the case whether or not Dr. W.

II. Lipscomb, the gray -haired defendant had any criminal connection with the sudden auu mysterious death of Charles T. Stewart in Jannary lat. Their names are D. W.

District Attorney Jones read the indictment charging him with the death of Stewart, through which ordeal the venerable accused passed unmoved, betraying no sign of emotion.

The witnesses were called, sworn and put under rule and then the introduction of testimony was begun. J. W. Duran, an uncle of the dead man, was first put upon the stand. He was at Stewart's home ou night the man died aud stated that after reaching his house from DcKalb Stewart attended to the chores ate supper and after entering into a general family conversation, bathed his feet and swallowing a cap sule that ho had brought with him in a little pill box, retired.

There was only one capsule in the box. Ten minute: after swallowing the capsule Stewart Complained of suffering greatly and tremor after tremor passed over him. These symptoms became more violent and in something more than twenty minutes, maybe longor, ho was acorpse. On cross examination witness never deviated from his direct testimony. The most important testimony given in was that of Dr.

W. R. McKinley, who also attended the autopsy. He testified as to the general appearance of the body, and the vital points corroborating the physicians previously testify ing. Dr.

alcrawey also testineu mat during the progress of the trial Lips comb asked him twice abont the appearance of blood clots on the brain of Stewart zn seemed anxious to know as to this point. He stated that during the progress of the autopsy he heard Lips-say something to the effect that "I don't see why I should be expected to kill a man for the benefit of another one. Adding that he was not on i'riendly terms with that other one. Witness testified that he carried nearly half ot a kidney taken from the stomach of Stewart, together with some wine, alio tuken from the stomach. He tested the wine thoroughly aud found it to be nearly normal.

lie decided to make a test to ascertain the presence of poison (strychnine) iu the kidney, and taking the same, put it in a small vessel of al- chohol, where it remained for several days, after which time he took a hyper-dermic syringe and injected it into a cat. Iu about fifteen minutes the cat was seized with tetauic convulsions and after going through four died in the fifth, exactly thirty-six minutes from the time of the injection with every indication of poisoning by strychnine. Witnoiis also testified, as did othor phy sicians previously oxamined, that there were traces of syphillitic poisoning iu Stewart's stomach. Dr. J.

B. Moouey, of Scooba, being introduced testified that he compounded on the afternoon prececding Stewart's death thiei capsules, a prescription of Dr. Lipscomb. Dr. Maher, a ia tner of Lipscomb, usually fibs the latter's prescriptions.

The prescription called for bromide quinine 10 grains, anti-kammia, lOgrains, strychniueN.V.8-60 grains. This was to be equally divided into three capsules and the directions were to take one before retiring. Witness having no 1-00 of a grain of strychnine tablets, so informed LipBcomb, who was waiting to receive the medicine, whereupon the latter told him he might a-i well UHe 1-30 grain ablits. Witness did ho and put one tablet in each capsule pnt the three in a pill box, wrote the directions on the face of the box his labtl on the bottom and gave the medicine to the defendant In his recollection Dr. Lipscomb had never purchased medicine from him before for the man Stewart.

During the past year his books show that he has filled seven prescriptions that were written by Lipscomb. Witness heard of Stewart's death early next morning. Was present at the autop of the body nd described its condition. The skin was discolored, face bloated, and when blood flowed copiously when cutting through flesh iuto the skull bone, into the brain. There were no bloody clots ou the brain, but arteries of the brain were empty, while the vessels of the brain were full as were those of the heart.

The stomach, kidneys, liver and oue or two other vessels were removed and later examined. It was the opinion of the witness that 1-4 of a grain of strychnine would produce death. J. M. Stewart, the father of Chus, T.

Stewart, testified that he was In Scooba with his son on afternoon in question. Saw his son, Guy Jack and Dr. LipBcomb talking together in the rear of Jack store Saw Lipscomb leave with something in his hand and go to Mooney drug store and return He later saw the box and was emphatic that it contained only one capsule, which his son swallowed. The testimony of Dr. W.

E. Pearson, who also attended the autopsy, was fh the main corroborative of that given in by Mooney as to the condition of the body. 1 Court adjourned at 4 o'clock till tomorrow morning at 9 o'clock. It is the general opinion that the trial will run nvw into next week. THE MISSISSIPPI SAY SO.
