ATLANTA, Jan. 11 ITJ Former Gov. John M. Slaton, Georgia's governor 40 years ago, died today in an Atlanta hospital. He was 88.

Slaton, an Atlanta resident nearly all of his life, died of a cerebral blood clot. He had been active in Georgia politics and law for more than 65 years and was at work in his law office Wednesday, the day before he became ill. Slaton was elected to the Georgia house in 1896 and later served as president of the Senate. He was acting governor for a few months in 1900 when Gov. Hoke Smith became a U.

S. senator. Elected In 1913 In 1913 Slaton was elected governor for a two-year term. It was during his administration that the celebrated Leo Frank case came to trial. Frank was convicted of slaying 13-year-old Mary Phagan.

H. Toole and Sons and had been a resident of Tampa for the last 29 years. He was a native of Winder, Ga. He was a member of the Hyde Park Methodist Church. A member of Sigma Alpha Epsilon fraternity, he attended Emory Uni-- versity and Georgia Tech.

Mr. Toole also operated a turkey farm at Brandon. Survivors are his widow, Mrs. Helen Robson Toole; a daughter, Katherine Ann Toole, both of Tampa; four brothers, Warren H. Toole Tampa; S.

W. Toole, Asbury Park, N. Franklin Toole, and J. C. Toole, Tampa.

Funeral arrangements will be announced by J. L. Reed and Son. Patrol Officer's Father Is Dead Guy Washington Prater, father of State Highway Patrol Lieu-! tenant James A. Prater of Tampa, died Jan.

7 in Opelika, Ala. Mr. Prater is a former police chief at Palatka. Mr. Prater was buried at the Cairo Cemetery, Cairo, 'Georgia.

VACIIELL BATH, England Horace Annesley Vachell, 93, one of the most prolific writers in English literature who wrote his 100th and last book a year ago, and whose best known works were Quinney's and The Hill. Died James T. Swann, 33, of 2502 Watrous Tampa business man, died at his home yesterday morning following a heart attack. A native of Tampa, Mr.

Swann was president of Swann Products, cigar factory and mail order cigar company, at 314 Madison which he headed since his father's death about two years ago. He had real estate and cirtus interests. He served as King of Gas-parilla in the 1941 annual pirate festival and during its suspension of the World War II years. During the war he saw service in the Air Force, and attained the rank of major. He was decorated with the Legion of Merit Award, and three Presidential Unit Citations.

Commended For Valor The Legion of Merit commended him for valor while an intelligence officer serving in New Guinea at Port Moresby in 1942, when enemy aerial attacks and close proximity of enemy troops greatly endangered operations. Born Sept. 6, 1916, Mr. Swann was the son of the late James T. Swahn and Mary Cotter Lucas Swann.

He attended Tampa schools, Culver Military Academy, Wharton School of Finance, and the University of Florida, entering the Army on his graduation. While reigning as King of the Gasparilla festival, Mr. Swann married the former Miss Ruth Binnicker, who was Queen of the festival at the same time. He was a member of the First Baptist Church, Tampa Yacht Country Club, Merrymakers, The Exchange Club, Palm Ceia Golf Club, and the SAE Fraternity.
