alander. The jurisdiction, therefore, cornea to depend upon its being established that fund belonging to the defender, or either of them, hare been effectually attached by the pursuer's arrestment. It it not now maintained that any fund belonging to th defender Mr. Wright hat been so attached, 'and, therefore, so far as be i concerned the case it necessarily at an end. But the question remain as to whether fund belonging to Mr.

Walter hare been attached. No tho arrestment upon 'which the pursuer found arc in ordinary form, and the execution bears to attach in the hand of certain arrestees, certain sum more or leas due and addebted by them to the said John Walter, or any other person or persons, for his use and behoof. It appears from th evidence of the arrestee that they haro incurred debts for the price of certain adrrrtisementa which they hare inserted in The Timet. The defender says that he it not the proper creditor in these debt," but the true creditor is the copartnery or firm of which he it a member and if that bo so it would follow that he has no direct right of action to recorcr the debts contracted by this firm of which he is a member, and, consequently, that these debts could not 1 attached by avn arrestment in the terms I hare mentioned. Now, raisea a two questions in tho first place, whether the debts in question are owing to Mr.

Walter at an individual, or to the firm of which ho sars be is a member; in the second place, if they are owing to the firm, whether the right of Mr. Walter at an individual partner it such that the' debts due to the linn can be effectually taken in execution of his separate debt. Both of tbesequestion must be determined br the law of England, which I must take, as a matter of fact, to be pro red by the evidence of experts. I had the advantage of hearing from the learned counsel who were examined as witnesses a very able and exhaustive exposition of the law of 'England on these two propositions, and I had the more satisfaction in considering their opinions, because I find that upon all points which arc material to the present question they are sabstantially at one. I do not think it necessary to examine the eridence in detail.

The result of it is to make it perfectly clear that the debt in question are not owing to Mr. Walter as an individual, bat that ther are owing to a firm of copartners, of which he and others are members. Now, the fact of partnership being established, the next question is whether, according to the law of England, the right of a partner of a trading firm in the assets of the copartnery is of such a character that the debts due to the firm may be taken in execution by the separate creditors of the copartner for satisfaction of his separate debts. I think it i established by the evidence that, in that respect, the law of England is precisely the same as.the law of Scotland. 1 think it is proved that the assets of a copartnery belong to the partners jointly each of them baring an undiriied interest in the whole, and that what is meant by the.

share of a partner is a explained by the very eminent 'writer whose work the counsel referred to What it meant by the share of a partner is bis proportion of the partnership assets sifter they bare all been realised and conrerted into money, and all the debt and liabilities hare been paid and discharged." That is the law of England aa it is proved in eridence, and I think it is a perfectly accurate statement of the law of Scotland also. It follows, as a necessary consequence, that debts doe to a firm cannot be talfen in execution bya separate creditor of. a partner a debts due to him as an individual. It is said that the rule of our law, by which the separate creditors of an individual partner cannot arrest. the debts dne to the copartnery, rises from a principle which ia not recognised in England, by which we consider the partnership as a separate pertona distinct from its members.

Bat it is not, in my opinion, because of the mere impersonation of a firm that its assets cannot be arrested by the creditors of a partner, but because the partner hi no separate share in the assets which i capable of being attached by the diligence. Tho principle is that sv partner has no right to any particular portion of the assets as belonging exclusively to him, and neither his assignees nor his separate creditors can have anr higher right against the joint property than the debt froji which they derive their interest. The true ground; therefore, is that which is stated in Lord Fitfour't note, quoted by Mr. Bell, when Be 6ayt that the creditors of a partnerean only affect his share of the balance after payment of the copartnery debts. The propositionproposition maintained, for the pursuer it very startling, because it comes to this that the separate creditor of anv partner of an English trading firm may seise funds belonging to the firm which.

he may find situated in Scotland, and carry them off for tho satisfaction of his separata debt. I think there ia no authority in tho law of Scotland for that proposition. I think the aame grounds upon which we should hold that the arrestments now in question were quite ineffectual to attach debts due to a Scotch copartnery are directly applicable when the question is whether they are effectual to attach debts due to "a copartnery in England. Mr. Balfour, in his argument, referred to the case in which it had been held that ships could bo arrested for tho debt of a part owner.

There i no analogy between those case and the present, both' because the character of the right of the part owner in a ship is altogether different in its legal character from the interests of a partner in the assets of a trading firm, and also because the arrestment is a diligence of a totally different kind from the arrestment of a ship. The arrestment of ship is a diligence rest. The ship is seised and detained in Court until it is set at liberty in due course of law. But the objection which the defender takes to the arrestment founded upon ia that they attach The arrestment of the debt, therefore, founding jurisdiction wa for execution of and diligence in a totally different way from the arrestment of a ship. It operates in vtrtonam.

It interpel the arrestee from' paying bis debt to his proper creditor, and ultimately; compels him to stake it forthing to the arresting' creditor, and therefore discharges him of his debt to his own creditor. ow, if that be the operation Of the arrestments founded on by the pursuer, it appears to me to follow that they cannot bo effectual except against debts due directly by the arrestee to the defender for whose debts to the pursuer the arreat meota are used. Mr. Balfour, in the course of his argument, said, and, I think, quite soundly, that it waa a very good, test of the validity of an arrestment to consider wEeUaec the fund which is attached by that arrestment could be taken in execution by the decree sought'' for in ttm action. Now, I.

think it very clear that no decree in this, action could be pronounced against any case utcept the individual defenders, and that no right of execution founded open the decree could be carried! into effect against the property of anybody else that tho individual defender. Mr. Balfour's test, therefore, appears to me to be quite conclusive el the Question. Tl debts errestc4 are true debts, which are. doe, not to the individual defender, but to him and a number of other persons jointly; and no decree in Unaaetion could be carried into execution by ordering the payment of these debts to the separate creditors for the defender.

There is no other ground of jurisdiction, I think, requiring consideration, and tie judgment moil be to sustain the first plea la law for the defendars and to dismiss the action. The LORD Advocati. Henry Howard, mb of the first earl by the eldest daughter, of the third Earl of Koseberf, wa born at Southampton in 180O In 1K32 he married Elixa, the only daug'Uer of General Sir Gordon Drum mond.G.C.B. He succeeded his father in 1845.

He was a descendant of the ducal house of Norfolk, springing from Lord Mill rim Howard, the eldest son of the second duke by hi second wife. The first Baron Howard of Effingham wa created in 15M. and was Lord Privy Seal in the rcija of Qjeen Tho deceased Earl is succeeded by hi son Henry, Lord Howard, who was born in 1S37 and married, in 18C5, Victoria 1'rancisca, eldest daughter of M. A. Boyer, of Paris.

Spencer Lyttclton, for soma year Marshal of the Ceremonies to the Queen, which occurred at his residence, in Eaton terrace on Monday niht, after a very ihort illness, He was the second aou of William third Lord Lyttelton, by hi marriage with Lady Sarah Spencer, eldest daughter of George John, second Earl Spencer, aad was Lorn in ISIS. II wa for some years in the Navy, and afterwards eritered the Scot Fusilier Guards, but retired in 1841. He was attached to tho Legation at St. Peietburg in 1847, and shortly after wards 'resigned.

He was then appointed Marshal of the Ceremonies to the Queen, but relinquished that position in 187. Mr. Lyttelton married, in 1848, Henrietta, eldest daughter and co heir of the late Mr. Frederick Hamilton Cornewall, of Delbury, Shrop shire, and granddaughter of the Right llcv. Dr Cornewall, Bishop of Worcester.

The death is announced from New York of Mr. George 8. Phillips, wiJcly known as January Eearle," who expired at the Morristowu Insane Asylum, New Jersey. Born at Peterborough, England, in 131a, Mr. Phillip wa educated at Trinity College, Cam bridge, where he took tLo degree cf B.A.

Visiting the United States, he was connected for a time, with several New York papers. On his return to England in 1845 bo edited the Ltedt but iu 1840 be received the appointment of secretary of the People's Colleges, Huddersficld, and was subsequently made secretary and lecturer to the Yorkshire Union of Institutes. After a few years, however, he again went back to America, and became associated with Mr. Charles A. Dana on the ChCccgo Tribune.

At a. later period he was literary edUor of the Keie York He was a prolifis and graceful writer. Mr. Phillip lost his reason in 1873, and after being three years in the Trenton Asylum for the Insane, was transferred to Morristown in 187C. Mr.

Taoms Bir.nv attended to answer an indictment for a common nuisance, causing large numbers of persons to assemble in front ot No. 107, Whitecbapel road, near a public highway called the Whitechapcl road, there making great noises and obstructing tho highway.

Mr. Poland, Q.C, asxl tho prosecution Mr. defence. Mr. Poland, in opening tho case, said that the pro ceeding was instituted by tho District Board nf Works for Whitecbapel, and at the instance of a number of the ratepayers in that neighbourhood.

A memo, rial was sent to the vestry asking them to put a atop to what was considered to be a public nuisance No. 10C and 107, Whitechapel road but tho vestry not having the control of the highway, the memorial was presented, to the District Bo sad of Works. Notice was given, to the defendant that unlets the nuisance was stopped proceedings would be taken against him, and it had become necestary to prefer ths present indictment in order to hare the tried. At the corner of Thomas street was No. 100, Whitschapel road, and next door was 107.

Up till November, 1887, shows. "were carried en at the two houses, pictures and placasda being exhibited which attracted a large number of people. Since that date the defendant had been working tho two houses together. There were waxwork shows, fat women, ic. Pictures were exhibited, and at times tho showman would come out and shout and beat the canvas partition with a cane to attract people's attention.

It was stated that many thieve used to frequent the crowd outside the premises. In the autumn of last year waxwork effigies of the women who were murdered in Whitechapel were included in the show, and a picture on the subject was exhibited. This picture was, howcrcr, considered by the public to be too strong, and the people threatened to tear it down. Tho defendant took the picture away. A wax effigy of Jack tho Ripper was added to tbo exhibition.

There were" also exhibited a fat Frenchwoman, a female' pugilist, and a woman described as being half a gorilla, a midget, tc. Mr. Poland remarked that, whatever might take lace on a racocoursc or in a country fair, this sort of thing sould not be carried, on in one of the main thorough fares in the metropolis. He did not think the jury would consider it a very great evil toe people oi Whitccbujpel should not hare the opportunity of seeing these exhibitions. If the' defendant carried on his business quietly might ccntinuo to do so, but be must not carry it on in tuch a way as to collect numbers of people, neither must be make such noises as "to disturb the peace of the inhabitants.

Mr. Poland added that the case wa not one in which it was asked, that there should be any punishment, but it ws Talher a civil matter, in which it was desired to have thi question decided. It was contended on tho part of the prosecution that tho case came the rule of law (laid down in the case of The Queen Carlisle (C Carrington and Payne Aiiutobcr of witnesses were called on the part of tho prosecution who stated that the trade in the neighbourhood was interfered with the sbqw. Mr. Pcuczll, in addressing the jury for the defendant, amid the show was one which did not in any way contravene the law.

No unnecessary noise was caused and no obstruction created any more than was occasioned by the numerous stalls and hhows which lined the Whitechapel roed. A number of witnesses were called for the defence who gave eridence to the effect that no interference wa caused to trade in the neighbourhood by the defendant's show. There were a great number of stalls and shows all along the Whitechapel road. A number of tradesmen in tbo neighbourhood had signed a memorial in favour of the show, which was dcscaibcd by one witness as being a benefit to trade, inasmuch as it attracted people to the locality. The defendant was himself called as a witness and cave evidence in bis own defence.

He stated that he had carried on the business for Fotne years and paid a rent of 245 for the premises. He Lad some picture outiide referring to the Whitecbapel murders, bet when hs had notice that they were objected to he took them away, and he had also as tar as possible diminished the His object was to attract persons into tho show and not for them to remain outside. His men did not allow the people to collect outside and had asked the police to help them. The KecokDEK, in summing up, pointed out that tradesmen, who exhibited, their foods in their shop windows could not be proceeded against for causing a nuisance if people stood looking in at the windows, but people who collected in tbe street and caused an obstruction of tbe thoroughfare micbt be proceeded against. If it were not so ho did not know where proceedings of this kind would stop.

Tbe jury retired to consider their verdict, and after deliberating for a considerable time returned a verdict tf Ouify. A man named LlKbLEV also appeared to answer a similsr indictment. The defendant, who is the proprietor of a show in the came neighbourhood, said be admitted causing a little obstruction there once a week. The RtcoRiitr. ordered each defendant to enter into his own recognisances in 100 to cotae up" for judgment if called upon, and said that if the nuisance was not continued they would hear nothing further of the matter.

A solemn Reqaiem Mas was celebrated ytiterdlj forenoon in memory of the Crown Prince Rudolph, at the. Roman Catholic Church in Farm street, Berkeley aqusre. Long before 11 o'clock, the hour appelated for tbe celebration, the church was filled with spectators, admission being by ticket. The walls were bttng with blaek cloth, on wbieh were purple shields bearic tbe initial turmounted by a coronet in gold, and soma being emblazoned with the arm of Austria. The altar, pulpit, and the sests reserved tor the members of the Court and tbe Corps Diplomatique wero also draped in Uack, outlined in gold, and the sanctuarv wat carpeted with purple.

The aeals set apart for the Royal Princes were covered in scarlet' edged with gold lace. Facing the high altar was placed a magnificent gUt catafalque, with four tall standard bouquet candelabra at the cerners, and 13 smaller branch candelabra grouped around; Lilies cf tie valley, hyacinths, e.ucharis lilies, and primulas, relieved with fern and palms, being anacged in the intervening trace. The creio rail wa of rich purple relvet, fringed with heavy gold buUien, and embroidered in gold.
