Swinborne, of this city, filled a lengthy bill in the Circuit Court yesterday against the Mercantile Insurance Company ol Chicago, by which he propose to put an end to the career of this institution fcj a winding-up process. The complainant tells the eourt that he owns a certificate for ten shares of full paid-up capital stock of the company of the par value $100 each.

The company gained its existence through a special charter in 1825, which authorised it to take marine, fire, or life risks, and the capital stock was fixed at $100,000. In 1869 the new general insurance law was passed, and by it this company became liable to make yearly reports to the Auditor of State. In December. 1872, John Olney, the then President of the company, applied to the Auditor for leave to comply with the new law. He represented that the capital stock was $157,000.

An examination was then made by George W. Smith, J. H. Kellogg, and E. W.

Russell, a commission appointed for the purpose, and the affairs of the company were found to be in a very unsatisfactory condition. The commissioners resorted that the securities were largely overvalued, and that the titles to the lands were defective in neauy every case, having been derived through tax tales. vu inese grounds ue commissioners reported that tbe company was not in a fit state to transact easiness. Tien, in January, 1873. the President of the company resported to the Auditor that it had a paid-up capital of $100,000, and asked for another examination, bur.

it was never made. Notwithstanding this, the company went on doing business for, January. -1874, it tied its annual report in Springfield, by which it showed a surplus of $74,790.27 as regards policv holders, be it it also acknowledged an impairment of capital to the amount of $21,209.73. Then again, in January. 1H75, another report was filed for the busi-ne-s of 18M, which showed ttio gross assets to be J300C8, vs bile the total liabilities were 320,939.

Tfce officers, he says, have been drawing large salaries end doing ant little work. For instance, W. Brewer, the President, draws $4,000, aod his account is overdrawn 1,400, while he is irresponsible.

Again, in 1875 James Sweet was appointed exsm-iner for the of Nebraska, and in such capacity looked throuah the affairs of the company and called on it to show a deposit of in some bank aocordang to the laws of that State. Thereupon he was given certificate of deposit -with the bank of Levi Wing A Co, of Chicago, for $25,000. Swinborne, however, sarys that this was a frauid, as there was no such bank in existence, and that tlte Commercial National was the institution where the company kept its account, but it had no funds therm at the time, and Swinborne tuinks there were no funds in Wing bank either. Ia the Circsit Court John Mattocks, an attorney of this city, say that Phillips assessed him $4,000 on property not worth more than $1,600. The State board then raised him to $6,080, and a tax of $254.71 called tor. Joseph O. Keefe filed a petition yesterday in the Circuit Court for habeas corpus against Sheriff BueL ef Waokegan, is whose custody he is. The vauae ef the restraint, as understood by the petitioner, is set forth as follows: Some time prior to the 19th of February, 1876. some one tied a pair of skates to the tail of aa old horse belonging to a Mr. Bnrke, residing at Lake Forest, and he accused Keefe of having done the act, and, is consequence.

Frank Bnrke, son Mr. Burke, said he was going to whip sr challenge Keefe to a fight Oa the 19th of February the two met at the PostofBce, and Burke got a blow ia the face which knocked him against a tree.
