The receiver in the case of W. S. Babcock' against the Appleby Manufacturing Company was on Saturday ordered by Judge Farwell to proceed at once to declare and pay to the creditors of the company as reported to the court May 27 last, or whose claims have since been allowed, a dividend of 25 per cent, in cash. He is also to tell as rapidly as dossIdIa, but without unreasonable sacrifice, all the assets of the company, except the machinery, and is to report his action to the court. A report was given a short time since In these columns of a petition tiled in bankruptcy by the assignee of the Northwestern Abel Loom Company, in which he claimed that the capital stock had never been paid up, although certificates of paid-up stock had been issued.and asking that an assessment of UO per cent, should be made on capital stock of the company to pay off its in debtedness. Saturday was the return day on the rule to show cause issued by tho court call-lug on the stockholders to show cause why the assessment should not be male. Several answers were tiled by stockholders. Foster admits owning three shares, but claims that bis stock should nut be assessed, for the reason that he holds it only as collateral security for a debt due him by one U. C. Uartwink, who owns the stock. Also for the further reason that the certificate states on Its face that it is non-assessable, and that he took It with the understanding that it was so. William Dickinson, the holder of five shares, claims that he should not be assessed, because bis shares were taken in good faith as collateral security for a debt, on the understanding that the stock was pliid up.

Armour A holders of five shares, claim tl. their shares were taken in pavment of a lii; out they admit that a certificate was Afterward issued to them. George Champlin says that he owns three shares taken by him as collateral security. No i certificate was. however, issued to him.

None of the above are original stockholders of the company, and no reasons are given in the answers filed why the assessment should not be made.
