First An act creating a taxing district and levying a tax upon the property therein for the banent of a turnpike road company ia not void because, soma of the property embraced therein Is Included In the taxing district of another company for the benefit of which It ia also taxed. Nor does the fact that the road Is of no valne to the complainants In this case or that the tax Is "useless and burdensome" Invalidate the act as to them. Second The act la unconstitutional and void so far aa it authorises the turnpike company to appoint an Assessor, requiring neither oath nor bond, and making no provision for a hearing by the taxpayer as to the value placed on hia property. Third-rln any event the: company did not have the power to appoint a person who did not reside In the taxing district to make the assessment, aa the Constitution requires all officers to reside in the county or district for which they act. Fourth The Legislature had power to levy the tax.

and to that extent the act Is valid. And by virtue of the general law the Assessor of the county should assess the property In the taxing district and return the same as other tax lists are returned, and the taxpayers should hare the same right to obtain corrections in or modifications of the lists as Is allowed by the general law. First Where a father gave to hia son a debt upon another, but subsequently brought suit upon the debt and had an attachment levied upon the debtor's property, and In compromise of that salt the dsbtor conveyed the attached property to Uie creditor's son.

In this action by his father's creditors, to subject what he owes his father on account of that undertaking, rely upon the original gift of the debt to him, and plead the statute limiting actions for relief for fraud to ten years. The parties having aubeeouently Ignored the original transaction, the sou can not now rely upon it. And the promise to the father being in writing an action thereon is not barred until the lapse of fifteen years from the time it was made. Appeal from Pendleton Circuit Court. Opinion of the court by Judge Haslerigg. affirming. First Under Section W7 of the Kentucky Statutes, which provides for the punishment of any person who shall willfully and maliciously displace or disturb "any rail or other fixture attached to the track or switch of any railroad in operation." an Indictment need not allege in the lansruase of the statute that the flxture disturbed was "attached to the track or switch." tt bemg sufficient In this case to allege that the defendent committed the offense by "displacing and disconnecting the connecting rod of the said switch." Second There being soma testimony tending to show guilt the court properly refused a peremptory Instruction to find for the defendant. Third Where, after the Jury had retired to consider the case, a Juryman expressed a desire to ask a question of counsel for the Commonwealth and when refused the privilege asked the court in the presence of the entire Jury if less than twelve of their number could make a verdict and was answered in the negative; and afterward when asked if they could agree the Juror replied that one of the Jury had said be "would hang the Jury for a thousand years but was stopped before finishing the sentence, this did not constitute euch misconduct of the Juryman as to affect the substantial rights of ths accused.

Where husband and wife owned adjoining tracts of land which were cultivated as one farm, the fact that the dwelling-hotise in which they resided waa located upon the wlfe'a part of the land did not deprive the husband of the right to the homestead exemption out of that part of the land owned by him, as they are to le regarded as residing upon his land within the meaning of the homestead law. An order dismissing the old case of H. A. and T. Gooch against the Cm-sens' Electric Light and Power Company has been entered In the Law and Equity division, the litigation having been settled. The plaintiffs sued for $22,000.

Prior to October. 1890. the plaintiffs were the sole stockholders of the Gooch Electric Company. On October 14. 1890.

they claimed, they subscribed for 800 shares of ths defendant's stock, ths defendant having been incorporated under the style "Gooch Electric Light Company." In March. 189L ths nams was changed to ths CiUsens Elect rio Light and Power Company." Plaintiffs claimed that they agreed to pay for the stock, and to transfer to the defendant the machinery, plant and franchises of the Gooch Electrio Company, which carried a considerable Indebtedness. Ths 800 shares were transferred to ths plaintiffs. They retained 100 shares aa compensation for their services in organising the defendant company. Ths remaining 700 shares were transferred back to the defendant, which was to sell the stock on account of plaintiffs for not less than 50 per cent, of ths face value.

Out of the proceeds the defendant was to pay the debts of ths Gooch Electrio Company. Including about $3,000 cash, which had been put in by the plaintiffs. Out of the residue the defendant was then to pay itself the $16,000 purchase money due for the entire stock subscription. The sur- lus was to be surrendered to plaintiffs. The latter allege that the defendant sold these 700 shares of stock for They asked Judgment for any balance remaining after paying the debts of the Gooch Klectrio Company and ths $16,000 due for stock.

The defendant In Its answer claimed to have In Its hands for plaintiffs, after the payments of ths obligations mentioned, $118.79. In their reply ths plaintiffs asked that the defendant be required to carry out its contract to pay them $22,000. that sum being named as the consideration in he deed conveying ths machinery. POISONED HIMSELF. Unfolds of a Popular Young Druggist of Kd in burg, Ind.

Franklin. April 6. (Special.) Thomas T. Coons, a leading druggist of Edlnburg, ten miles below this city, committed suicide this afternoon at his store. He had had a quarrel with his wife, and on leaving home told her that he would shoot himself.

She thought It was only an Idle threat, but later In the afternoon she learned that he bad been found in a dying condition. Examination showed his death due to a violent poison. Ths cause assigned Is domestic trouble. Mr. Coons was thirty years old and leaves, besides his wife, one child.
