Judge Burnett, of the Court of Second Instance, ha allowed a writ of error in the case of oseph Daniels, who, after a fair trial, bad been convicted of tha murder of his comrade, Peter Pettit, by shooting him through the bead while on a bunting excursion between this city and the Mission Dolores. Daniels is now on board a vessel of war, and would have been banged to-morrow, had the aentenoo not been suspended by a higher eourt. Tb courts of equity (not of law) were inundated with the most comiilicated eases of litigation, growing out of the looseness of real ttat purchase! and operation.

Tb punishment of masters of vessel by passengers, has been another prolifio souree of wrangling and litigation. Th greatest misery and sufferings have grown out of the abuse and maltreatment of passenger by th masters of vessels and nin out of tea have beea prosecuted, and made to pay dearly for tbeir inhumanity. Business at the mines has been good, and tbey hav yitlded an average of $16 per day. The number at work through the various diggings, is computed to be about thirty-five thousand. Colonel Weller, the commissioner on th boundarv survey, was shot through the leg by Mr. Greaves, one of the surveyors, previous to ths arrival of the C. at San Diego, where the Colonel was under medical treatment.

The utmost activity prevailed In all branches of trade. The speculations either in real estate or in merchandise were not so wild, and there were more confidence and firmness in all transactions. Speculators were in the market before the sailing of the California, buying up all the flour and pork, at immense heavy prices. Their calculations of profit are based upon the fact, that between the months of January and Juno last, the exportations from the Uaited State were limited, and hence an increase in prices. Imported provisions, "with th bar exception of beef, hav become acaroo and high.

Lumber, th ureat and greatest article of trafiio, was yet in demand at high prices. A rain storm on tb 9th of Ootober, and one more recast, forced on the occupants of canvass stores and bouses, th necessity of providing against future losses. Th damage done to merchandise by th rain was very heavy, being estimated at $100,000 in San Franoisoo alone. Lumber, in consequence, took another rise, and was still high. These persons represent, tbat tb emigration bad about reached the foot of the mountain on the Car ton route, by the (ink oi Mary river aad that near the (ummit of the range on this road, they met relief trains going forward to those who might need assistance. Most of the belated emigration were induced, by representations on the way, to take the Lawson route which diverges to the north, on the right, about 80 miles above tha sink of Msry 't river; but subsequent information says, that they have taken the moot diffioult road, aad will to from one to two weeks later arriving at tbt settlement. There ba been a great deal of trouble, loss and toil, from losing teams, on the way, but the peo ple were pretty wen proviuea witn provisiou, and thi were no particular maladies among them, with the exception of alight scorbutic symptom among torn trains. We neglected to say above, tbat relief baa also beea sent to the Lawson route, and that there is no apprehension of any serious calamity befalling any person or party on that road.

On tha 13th instant, it commenced nowins on tha Sierra Nevada mountains, for th first time during this season. It fell to about tb depth of eight inches.
