The 3-year-old's body was found at about 6:30 p.m. Saturday in a motel pool two miles from his mother's apartment. His mother said she last saw the boy about 11 a.m. that day.

Osceola County Assistant State Attorney Jeff Miller said he has not yet decided whether to file official charges against the boy or whether the boy should be tried as an adult. Police said the 9-year-old confessed to pushing the child into the pool, watching as he sank to the bottom and then going home. The boy has not said why he pushed the younger child or why he didn't get help, police said.
