40 Will FRIDAY, MARCH 22, 1985 ST. PETERSBURG TIMES HIGHLIGHTS broadcast ABC from 1-D doesn't know what it will do. And the above scenario, while logical economically, is not without holes. Hanging on to Houston and Philadelphia still leaves Capital Cities slightly over the federal limit. In addition, another FCC rule prohibits owning stations with signals that overlap, and the ABC station in New York covers some of the same area (New Jersey, mostly) as the Capital Cities xi jrLr Hi.

"Whatever they decide is fine with me," said Lew Freifeld, general manager of Channel 28 referring to Capital Cities upcoming corporate decision. Freifeld, meanwhile, is leading the station to its highest ratings ever. And as the company contemplates its array of stations, there remains one advantage to retaining In the 25 percent calculations, everyone agrees it only counts for half. Several disadvantages also remain, however: No network has ever owned a UHF station. They're considered small potatoes.

But more to the point, no network has ever owned a station that did not carry its network programing. ABC already has a strong, VHF affiliate locally in Channel 10. The network would have nothing to gain in shifting its affiliation to a UHF station even a UHF station it owns. "Whatever they decide is fine with me," said Lew Freifeld, general manager of Channel 28. He's making a success of the station.

Arbitron's February ratings report shows WFTS with its highest share of audience ever (5 percent) and rival independent at its lowest (7) in some time. THE POSSIBILITIES grow intriguing. If Capital Cities chooses to keep WFTS, it could find the station eventually landing on the VHF spectrum. Recall that WTOG has arranged to move public station WEDU off of Channel 3 and take its place as a commercial operation. A jealous WTSP is asking the FCC to open up that deal to other stations.

If the FCC does step in, it will probably be to hold comparative hearings among various applicants for Channel 3. WTOG would be one, WTSP another, and WFTS would almost certainly apply as well. If the Capital Cities station prevailed, logically would operate not as an independent but as an ABC station, robbing Channel 10 of its affiliation. It's not a likely outcome, but neither is it impossible. Lately, on the business side of broadcasting, nothing seems to be.

because it broadcasts on the UHF spectrum (channels 14 to 83), the FCC considers WFTS's coverage area as two-thirds of 1 percent of the population. That's small solace to Capital Cities, however. The ABC-owned stations together reach 20.75 percent of U.S. homes. Capital Cities' seven stations reach another 7.75 percent.

Together, the 12 stations reach 28.5 percent of U.S. homes more than 3 percent beyond the limit. Capital Cities must sell some stations to duck below the new ceiling, and its chairman has said he doesn't expect to deal away any ABC stations. All are highly profitable operations in major cities (New York, Chicago, Los Angeles, Detroit and San Francisco). Certainly Capital Cities could not have purchased a network three times its size if it did not operate exceptionally profitable stations of its own.

But only two of them are in major cities: Philadelphia and Houston. It will want to hang on to those, "the two most profitable television stations in the country," said Alan Henry, president of Gulf Broadcast Group, which owns (and is itself being largely acquired by Taft Broadcasting). PUBLISHED REPORTS say Capital Cities has already put its Buffalo, N.Y. and New Haven, Conn, stations on the block. If it also sells KFSN-TV in Fresno, WTVD-TV in Durham, N.C.

and our own WFTS, the new Capital Cities will reach 25.4 percent of TV homes the ABC station's 20.75 percent, plus Philadelphia (2.9) and Houston 41.6). Through spokesmen, Capital Cities says it CBS station in Philadelphia. CBS owns stations in both New York and Philadelphia, but that overlap violation was "grandfathered in" when the FCC passed the rule. In the name of fairness, Capital Cities could ask for a similar waiver and put in for an exception on the 25 percent while it's at it. IF EITHER request is denied, however, one of the big-city stations apparently will have to go.
