Donald E. and Yvonne beasecker filed an action Thursday for declaratory judgment in an attempt to reverse a zoning change on property they own in Seminole. In the suit, the Beaseikers ask that a County Commission decision changing the zoning from commercial to residential be reversed. The property in question is located across from Seminole High School on 86th Avenue west of 131st Street. The suit also asks that the county be enjoined from enforcing the residential zoning.

The Beaseckers' attorney told the County Commission in January that Beasecker bought the lot because a county employee told him the zoning was right for an ice cream parlor. But the employee apparently did not know that the county land-use plan which also restricts what can be built designated the lot for residential use. Because of the employee's error, the county staff recommended that the land use plan be changed to accommodate Beasecker. But nearby residents protested and the County Commission instead changed the zoning to conform with the land-use plan.
