Charge dismissal for Webb upheld by appeal court Pasco Times Bureau DADE CITY The 2nd District Court of Appeal, in a split-decision announced Wednesday, upheld Circuit Judge Robert L. Williams in his 1973 decision to dismiss charges against Raymond M. Webb, who has been charged with receiving and concealing stolen property. Webb, whose wife is part owner of Dade City Radio Station WDCF, and who, when he was arrested, was publisher of "Pasco East," a Dade City daily newspaper now under new ownership and known as "Pasco News," was arrested July 20, 1973. At the time Webb was a central figure in a hot political controversy involving the Dade City Commission, Dade City Police Chief Norris Nixon and Webb.

Webb was running a series of front -page editorials criticizing city government and the police department. He was arrested based on information from Tony Dexter, a former employer of Webb's, who admitted to taking recording equipment from Radio Station WPAS in Zephyrhills after that station was heavily damaged in a fire, and who said that he gave it to Webb and told Webb it was stolen. Dexter had been flown to Dade City, at Nixon's expense, to give his testimony. He was granted immunity from prosecution on grand larceny charges in return for his statement implicating Webb. The central question before the appellate court was whether the offense of receiving and concealing stolen property is a continuing offense.

Williams, in dismissing the charge, ruled that the statute of limitations had expired since Webb allegedly received the radio equipment on May 10, 1970, and that the charge is not a continuing offense. The state had contended that Webb was as guilty on the day he was arrested as on the day he allegedly received the equipment. Judge T. Frank Hobson Jr. wrote the decision, and he and Judge Stephen H.

Grimes agreed with Williams. Judge Joseph P. McNulty dissented and said in a minority opinion that he felt that the legislative intent when the law court POLICE log was written meant for concealment of stolen property to be a continuing offense. Investigation continues in suspected murder Pasco Times Bureau DADE CITY Pasco County Sheriff's Department detectives Thursday reported 1 no new leads in the case of Gerald Brown, 36, of St. Petersburg, who they believe to have been murdered in southeastern Pasco late Saturday night.

Brown's body has not yet been located. The case came to official attention late Saturday when a man, believed to be Brown, ran up to the home of a Pasco resident seeking help because some men were reportedly trying to rob him. The resident, a few seconds later, heard a shot and then saw three men loading what appeared to be a dead body into a van. That van was registered to Brown, but Brown was not in it two hours later when Dade City police stopped it just south of Dade City. Three other men were in the van, and bloodstains were found in the van.

Deputies said they found five grams of marijuana in the van, and its three occupants are being held on drug charges. Later investigation turned up bloodstains and signs of a struggle at Brown's St. Petersburg home and indications that he has not shown up for work or been in contact with friends or family since early Saturday evening. On Wednesday St. Petersburg police found another car owned by Brown, and said they found a bloody shirt and other bloodstains in that car.

Four days of searching the southeastern Pasco area have proved fruitless. Chief Detective Lt. Ed Vogt said Thursday that his detectives are "checking out leads," but that 1 no organized search of the area was under way Thursday. Vogt said he is waiting for reports on fingerprints lifted from the house and car, and for lab reports on the bloodstains found in the van, house and car. Homosexual rape investigated at jail Pasco Times Bureau DADE CITY Pasco County sheriff's department officials Thursday were investigating the reported homosexual rape of one male prisoner by another at the Pasco County Jail sometime late Wednesday or early Thursday.

A small disturbance occurred at the jail Thursday morning when deputies had difficulty in moving the suspected rapist from one cell to another after the incident occurred, but the move was accomplished without injury to the suspect or deputies. Chief Deputy Dave Schneider confirmed that the reported incident was being investigated, but said Thursday that he did not know whether charges would be filed. Brooksville1 man charged with assault Pasco Times Bureau DADE CITY Burlon Fleming, Route 5, Brooksville, was charged with aggravated assault Saturday after he reportedly threatened another man with a knife. Fleming, 51, reportedly pulled a knife on Ronald Dusenberry while the two men were at the Majik-Market at U.S. 41 and Bowman Road.

Witnesses said Dusenberry armed himself with a softdrink bottle and ordered Fleming to drop the knife, which he did shortly before Pasco County sheriff's deputies arrived.
