Claude Kirk Friday called on the Duval County School Board to appeal and seek a stay of Federal District Judge William McRae's Thursday desegregation ruling. "The decision by Federal District Judge McRae to disregard what has previously been his determination of a unitary system is an educational tragedy for Duval County," Kirk said in a letter to School Board Chairman Charles Bassett. "'The neighborhood concept has been severely jeopardized and basic educational principles pletely cast aside." KIRK ALSO again criticized the U.S.

Supreme Court for not defining a "unitary school system" and said: "Hopefully we are now at the threshhold of such a decision and while the children remain the unfortunate victims of this litigation, we should remain calm and continue to work within our system." In Jacksonville, Duval School Board Attorney Yard- ley Buckman said he believes an appeal of the decision to the U.S. 5th Circuit Court of Appeals would be "an exercise in futility and a waste of taxpayers' money." School officials and School Board members met in closed session to discuss what action to take at its Monday night meeting. Dr. Cecil Hardesty, school superintendent, said additional busing required by the order could cost $250,000. Hardesty indicated that a delay in the opening of schools is possible.

McRae said his order desegregates 12 schools that would have been virtually or entirely all-black, while still 1 maintaining the "neighborhood school" concept. The pairing and clustering involves about 5,338 Negro and 5,944 white students in the elementary grades. Hardesty rejected McRae's contention and said the idea was "nonsense, ridiculous." He said the judge "is guilty of hypocrisy."
