A. Bell by the as to the propriety or duty of the board oi supervisors the annual meeting In tober to review the equaliza ion of flto county made in June.

As published yesterday the attorney general holds that the Jun equalization this year was made for the benefit of the state board of equalization and that the law contem- piates that the board of supervisors shall -equalize county In October, as in other years. It has been cided, however, that failure to re- equalize at the October meeting does not invalidate the taxes otherwise regularly levied. This decision is of vital Importance to Marquette taxpayers, as it will afford an opportunity for them to get relief from the unjust burden of state taxes, imposed by the increased valuation of the county by the state board of equalization, which was made on the theory that the mines were under assessed. Unless Marquette proportion of the valuation of the county is reduced by the supervisors at the October meeting, local property will bear the increased state taxes in the same ratio as the mining and other properties. The attorney general's opinion follows: Sept.

14, 1911. Mr. F. A. Bell, attorney-at-law, Ishpeming, Michigan: Dear letter of the 12th instant received and contents noted In reply thereto would say that the June equalization by board of supervisors is under and pursuant to Act 44 of the Public Acts of 1911, and is required for the purpose of aiding the state board of equalization in the per fonnance of the duties under said act.

Section 34 of the general law re quiries the board of supervisors at its October session in each year to equal ize the assessment rolls of the several or cities, which equalization is made the basis of the apportionment of the taxes in the couuty. This department lias uui forinly advised such equalization by the boar of supervisors at its October session In the years where the coun ty board is required to equalize In June for the purpose of aiding the state board df equalization in the performance of its duties. In the case of Silsbee vs. fltockle, 44 Mich. 661, and Boyce vs.

Sebrlng, 66 Mich. 210, it was held by the supreme court that where equalization was made at June session preceding meeting of the state board of equalization failure to equalize at October session would not invalidate the taxes otherwise regularly levied. The general tax law, however, clearly contemplates that the board of supervisors shall equalize at its October session as above indicated. PEttklXg NEWS.
