Mark, who has bees before the United Slates courts as defendaut in two trials for cruelty to his crew, was yesterday convicted in the criminal branch of the court, Judge Benedict pre siding, of. cruel and unusual punishment of a sailor kaown as Long Tom, by flogging and other indignities effected by the captain's own haod or by his direction. It is alleged that three sailors died nnder his cruel treatment. Capt. Grindle was flrBt arrested five years ago, when master bl the ship Old Colony, for lll-treatiag two Spanish refugees, Whom it wis alleged he attempted to coeice into signing the ship's papers.

On the trial it was proved that the men. were beaten, hoisted the main top, with heavy irons around their necks, and gagged with iron bolls, and confined in a dark hole fifteen days on an allowance of a biscuit a day. The men were so weak when taken from the ship that they had to be brought into court on stretchers. After a trial laetiDg several days Griadle was acquitted on technical grouads, the verdict being not truilty Under the statute, and the ruling of the court, but guilty of cruel attempt. sentenced.

Washington, Nov.S. rhe digest of crop returns for October, as prepared at the department of agriculture, indicates a reduction in the yield of the wheat crop of bear one-sixth; the whole quantity is somewhat superior. Every seotion of the Union indicates a reduction, except the middle states. The figures point to a yield of about two hundred and seventy-five million bushels. Rye is reported 4 per cent, less than '75, but the quality ia better.

Barley, 6 per cent, less than last year. Buckwheat, fall average. Oats show a falling off of 23 per cent, in every section of the Union. The corn crop is deficient, but the figures are cot yet obtained. Cotton crop will be large and likely to approach the heavy yield ot '75.

Judge Morton, in the Bute District Court today, upon the application of Adolphua "Meier, John A. Stewart and Mathew Baird, trustees in a mortgage conveying the entire line of road, appointed Carlos S. Greeley and Henry Vi? lard to be receivers i the Kansas Pacific R. R. The company claims that it would have been able to have avoided the action of the trustees of the bondholders if the United States had paid the sum due it for the transportation of mails, troops, which now amount to about half a million of dollars.

It is understood that the purpose of the trustees in taking thif action is to hold the property entailed, so that it may De operated as hitherto, without in any manner affecting its use by the public.
