But a President eatinot be chosen while there is a Vice Piesident in office, until the close of their term of office. That this is so, ia apparent from the fact that the constitution requires them both to be elected at the same time, and for the iwi term, which preel udes the idea of electing a President alone, while the Vice President is still in office, acting as President in discharging his powers and duties. The Constitution says The Congress may determine the time of choosing the electors, and the day on which they shall give their votes; The Congress exercised this power March 1, 17U4, and enacted ihat elector shall tie appointed by each State for thceiectionjof a President and Vice President of the United State within 34 days preceding the first Wed-" nesoay of December, 17U-2. and within 34 days preceding Uie tirt Wednesday of December of every fourth fear niceetding the I ant and that the elector should meet on the first Wednesday of December thereafter and vote, and on the first Wednesdaj in January succeeding Uie votes rhould he counted in presence of both Houses, and the result declared, ascording to the constitution. In the lat ter case, there is an incumbent vet in case of "inability" of the President, the Vice President shall discharge his powers and duties, and uot ie Presideut, but simply Vice President. They are two distinct offices, and continue to be, notwithstanding the vacancy of one, alike creations of the Constitution.

The early Congressional construction of the Constitution, so near to what seems right on reading it, must it seems to me, be perfectly satisfactory to all. If the Vice President should be constitutionally disabled to act as President during his term, the President pro tempore of the Senate willed as President. And if the of-fico of Vice President becomes vacant for any other cause than lapse of time, as has that of the, President by death, the Secretary of State will then and not till then, take action for a new election of P. V. P.
