In early 1976. Burden surrendered his license to WIFE AM (1310) to an Indianapolis group which had challenged his fitness to have it. That group, in turn, sold it last year to Denver broadcaster Ken Palmer, who now operates it. Burden continued to struggle to keep WIFE-FM. but in its most punishing ruling up to that time, the FCC ordered Burden to surrender all his remaining broadcast licenses two in Omaha, one in Vancouver.

The FCC was so rancorous with Burden that it ignored its usual procedure of arranging for an interim operator to keep a station on the air until a new owner could be determined. Since Burden owned the building and equipment, he would have profited from an interim operation, and the FCC didn't want that The FCC ruling opened the floodgates for the rash of applications to take over the WIFE FM resigned from WTLC to lend his broadcast expertise to Cantor's application. In the intervening years, Johnston has worked for Can tor's theater enterprises, obtained a law degree and was admitted to the Indiana bar, and currently is on the president's executive staff at Methodist Hospital. The action by the administrative law judges is not final, but it does put the People's application ahead of the other four contenders.

Matter Of Taste Then there' are those who question the good taste of the Valvoline Oil commercial still playing on local TV stations. The race driver in the blurb has "Smiley" on his helmet Gordon Smiley, who was killed at the Motor Speedway last Saturday. Federal Communications Commission has awarded the license for the dormant WIFE-FM (107.9) to the application originally filed by Joseph Cantor, the late Indianapolis theater entrepeneur. The station has been off the air since Sept 2. 1976.

when the FCC stripped the former owner. Don Burden, of all his radio licenses. Originally, nine different companies applied for WIFEFM. but in the intervening years, four dropped out and only five still were in contention when a pair of FCC administrative law judges quietly issued their ruling Tuesday. Even though the judges ruled in favor of Cantor's People's Broadcasting, the fight isn't over yet.

The four losers all will have opportunities to appeal the decision to the full FCC. The losers, so far, in this bureaucratic marathon are Radio Circle City, with former WIFE general manager Robert Kiley as the most prominent name; MediaCom, with James Wier, Radio Corporation of Indiana, with Michael Gra-dison. and Indianapolis Communications with Ed Zebrowski. Cantor filed his application with the aid of Andy Johnston, former general manager of WTLC-FM (105.7). who will serve as general manager if People's Broadcasting ultimately wins the WIFEFM license.

After Cantor's death last Sept. 14 at age 76, the application by People's Broadcasting was amended, replacing Cantor's name with that of his son, Daniel Cantor, who operates his late father's theater enterprises here. Although no one is saying yet, a good guess is that legal fees for each of the five contending companies in the chase for the WIFE FM license are somewhere in the neighborhood of $250,000 each. High Stakes The stakes are high, but the potential is great. Value of the station at the time it was shut down by FCC order was between $700,000 and $125 million, depending on who was estimating.

In his best year of operating WIFE FM, Burden had billings of $491,000 and a cash flow of $100,000. The winner need only pay off his lawyers and a modest filing fee with the FCC. and the million dollar license is his. Nothing is left of the former physical plant which was WIFE FM, located on the alley side of 1440 N. Meridian.

Burden no longer owns the building, and the broadcast equipment has been sold or stored. Johnston said that when People's gets the ultimate go-ahead from the FCC he plans to build an entirely new station. The awarding of the WIFE-FM license will be the final act in a stormy 18 year skein of events surrounding the "WIFE" call letters. First, The Beatles It started in late 1963 when Burden of Omaha purchased the station and stirred up the local radio market with that new tangled rock 'n' roll music, primarily from a new British group called the Beatles. But, within weeks, he was in hot water with the FCC over fraudulent ratings claims.
