Defense attorneys claimed Warren's refusal devastated their case "The ruling takes issues away from the jurors and determines for them what inferences to draw from testimony and which witnesses to'believe," defense attorney Mike Ramsey said, Ramsey and defense attorney Bob Bennett contend Torres' "propensity for violence" shows that the two officers did not intend to beat Torres. The state contends that Brinkmeyer should be allowed to tell jurors about Demon's past because Denson testified he had never slapped other prisoners.

No one disliked him as a person.

"He was particularly obnoxious and always threatening to whip somebody. He wanted everybody to think he was real rough. "One time he physically attacked a truck. A van screeched to a halt at a crosswalk and for some reason he landed a karate chop on it which broke his arm.

"Another time, some MPs brought him in for glue-sniffing. They had found him in the with a garbage can over Ms head." Myers said he recalls most vividly the occasion the 54, impound Torres confronted four members of the Fayetteville, N.C., police department. "He kicked one of they worked him owr with nightsticks.
