Symmes Judge of Superior Court 4, urged both parties to agree on whether the parents had received a fair hearing before the School Board and whether the board can implement the parents proposal without further litigation. The action was filed last September by a group of parents who are asking the School Board to adopt regulations prohibiting reassignment of pupils under 10 years of age beyond the school nearest their home. The parents, rep-resented by Nelson Grills, Frank Symmes Jr. sympathetic to the parents position, but suggested that it is not likely the board will implement the parents plan since the board is under Fedr eral Court orders to bus elementary school children. Grills said the board has the authority to adopt the parents proposal and submit it to Dillin, who could determine whether it is constitutional.

According to Grills, Dillin never has had an opportunity to approve or disapprove a plan along the lines proposed by his clients. Grills contends the board has taken "an all or nothing" posture in the desegregation case and said the parents proposal is an attempt to achieve some middle ground. Under questioning by Symmes, both parties agreed the issue eventually would wind up before Dillin. Symmes urged that the board grant the parents an opportunity to present their proposal, and if the board denied the parents their plan the parents could present their proposal to Dillin. He suggested that if the board is firm in its position that the parents proposal would violate Dillin's orders, and a hearing would be a waste of time for both the board and parents, the board should so stipulate in writing, which also would give the parents an opportunity to intervene before Dillin.

School Board attorney Lawrence McTurnan assured Symmes the board is willing to listen to the parents proposal, and all the parents have to do is place their names on the board meeting agenda.
