A 48-year-old man, who allegedly gave a teen-ager a loaded revolver and dared him to pull the trigger, survived two shots to his head after the 16-year-old took him up on the challenge.

Wallace Harris of 420 University Terrace was treated and released from Lincoln General Hosptial for gunshot wounds. Police say one bullet lodged under Harris' skin above his left ear and the other entered the right side of his forehead and exited above his right ear. According to police reports, Harris and the teen-ager, who may be a relative, were fighting over money, when Harris got out a 32-caliber antique revolver and put two or three rounds into it. He then gave the teen-ager the gun and dared him to shoot. Nothing happened and the gun was put away.

However, the argument continued. At some point the Police said the teenager later turned himself in. He was taken to the Juvenile Attention Center on suspicion of first-degree assault. teen-ager got the revolver and shot Harris twice in the head. Apparently the wounds were not severe because, according to police reports, the fight continued and Harris took the gun away from the teen-ager, who left the house on foot.

The shooting incident occurred in the Air Park area at about 3:30 a.m. Sunday. Police said the teen-ager later turned himself in. He was taken to the Juvenile Attention Center on suspicion of first-degree assault. conditions and high temperatures Accu-Weather forecast for daytime S.D.

The conviction was reversed and a new trial ordered when it was learned that then-Lincoln County Sheriff Gordon "Hop" Gilster had played cards with jurors and discussed the case while they were sequestered. At a second trial, held in Lancaster County, he was found innocent by reason of insanity. Simants has acknowledged that he killed James Henry Kellie, 66; Audrey Marie Kellie, 57; David LeRoy Kellie, 32; Daniel LeRoy Kellie, Florance Marie Kellie, 10; and Deanna Lynn Kellie, 7.

Highs in the mid 50s to lower 60s. ASSOCIATED PRESS The attorney for mass killer Erwin Charles Simants asked the state Supreme Court today to rule his client is no longer mentally ill and dangerous. Simants, 47, has been confined to a state mental hospital since being found innocent by reason of insanity in the 1975 murders of six members of the Henry Kellie family of rural Sutherland. Last summer, Lincoln County District Judge Donald Rowlands rejected Simants' request that restrictions on Simants be reduced so he could more easily participate in group outings. He is confined at the Lincoln Regional Center.

The law requires the district court to conduct a hearing each year on Simants' condition. His next annual hearing is scheduled for June 1. Lincoln County Public Defender Robert Lindemeier said Simants' constitutional rights were violated during the 1993 hearing. He said Simants was not notified of the hearing. He also said Rowlands' improperly admitted the testimony of Dr.

Jack R. Anderson, an Alabama psychiatrist hired by the state, who concluded that Simants was schizophrenic and dangerous. Even if Anderson's testimony is considered, Lindemeier contends it isn't sufficient to show "clear and convincing" evidence that Simants remains mentally ill. "A lot of Hispanics are intimidated" by government, said Dora Lucius of Scottsbluff. She was one of 16 Hispanics with Nil's Cooperative Extension Service family and community leadership program who visited Lincoln recently.
