Tuesday, February 16, 1993 STATELOCAL The Lincoln Star Page 1 5 FCC advertising regulations frustrate gambling backers i OMAHA (AP) Orjen ment dollar. They need to remind you that thev are there. You trv tn art stead of the usual $1 minimum. Rolls and coffee are free until noon. Later cause they involve "prize, chance and consideration," Holberg said.

Horse and greyhound tracks are allowed to advertise because that kind of gambling is considered a skill, he said. The U.S. Indian Gaming Regulatory Act places no restrictions on advertising of casinos run by Indian tribes as long as the tribe has entered a compact with a state to open the casino, Holberg said. The tribes operating casinos in Iowa have them. IN NEBRASKA, the only charitable gaming activity with state-mandated advertising restrictions is bingo.

John Adams, director of the Nebraska Department of Revenue's charitable gaming division, said bingo advertising is limited to two signs on the premises where the game is conducted, while advertisement flyers cannot be bigger than 8Vs-by-ll inches. That would change under a bill proposed in the Legislature. The proposal would allow advertising by organizations licensed to conduct bingo but not the operator who runs the bingo halL "The fact is, with the other types of gaming that have sprung up, bingo has been at a disadvantage," said State Sen. Eric Will of Omaha, who supports the bill vertising on radio and television in states without lotteries, Holberg said. That is why none of the Iowa lottery's $4.9 million spent on advertising in fiscal 1992 went to Nebraska outlets.

The FCC also has concluded that when Nebraska cities and counties turn their keno lotteries over to a for-profit operator such as Omaha First or Big Red, they cannot mention gambling in their advertisements, Holberg said. FRED KELLY, who manages the Ralston keno lottery, said the FCC regulations frustrate him. He sometimes advertises on television, but he said he cannot be as specific as Ak-Sar-Ben, Bluffs Run or Casino Omaha which aren't restricted by the FCC. The FCC regulates lotteries be- 'Per, watch television or listen to a radio. Chances are good you will run jnto an advertisement calling you to join those winners who play a variety of gambling activities.

With more legalized gambling In the state, those who want people to try blackjack at casinos run by Indian tribes or play keno or bet on horse $nd greyhound races in nearby states or buy a state lottery ticket are relying on advertisements and promotions to attract customers. "There wasn't much at all and almost all of a sudden we have a whole bunch," said Denise Smart, a University of Nebraska at Omaha marketing professor who teaches advertising. They're competing for the entertain people to give it a try and they'll come back." Last year, two Indian tribes opened casinos in Iowa off Interstate 29, bringing to the area Las Vegas-type gambling with lower stakes. Casino Omaha, the Omaha Indian Tribe's casino west of Onawa, Iowa, competes with the Winna Vegas casino west of Sloan, Iowa. Both advertise in eastern Nebraska as well as in Iowa.

THE CASINOS, and a number of Nebraska keno parlors, are using special promotions to help drum up business. On weekday mornings at the Big Red Keno parlor in Omaha's Peony Park, a keno bet costs 25 cents in in the day, keno, hot dogs and tap beer are 25 cents. Omaha First the other keno operator in Omaha, also has special promotions, including free coffee and iced tea for players. The Federal Communications Commission regulates advertising for lotteries, including keno, on television and radio. Only lotteries conducted by states and charities can advertise on radio and television, and there are restrictions for them, said Roger Holberg, an FCC supervisory lawyer in Washington, D.C.

Although state lotteries can advertise, the FCC forbids them from ad Omaha police, city leaders suggest bills for standoffs "OMAHA (AP) Police and citv of in the unit worked a total of 141 hours of overtime.
