"These facts notwithstanding, I accept responsibility for the actions of my employees under the broad mantle of official dutes and functions inherent in my position as their Chief Executive Officer," Parratt wrote. One of the Adjustment Center incidents ap-: parently refers to the alleged use of paralyzer gas on an inmate in the center. Lovell wrote in his resignation that he was "convinced" an appeal would vindicate him completely of the accusations, but added he lacked the financial resources needed to support extensive litigation. Pease, who was a major at the Lincoln Correctional Center at the time in question, was not involved in the investigation.

His letter to Benson gave no reason for his resignation, but it is understood he left because of loyalty to Parratt. Benson had met with the key staff members Thursday and met with others Friday, but said he was refusing to elaborate at the news conference because he expected appeals and litigation to arise from his disciplinary decisions. Douglas, however, doubted that appeals would be forthcoming. "Frankly, I'd be sur- prised," he said. Whether criminal charges will be filed remains to be determined, he added, conceding that some charges, which "might include embezzlement" could result.

Benson said he will forward the patrol's reports to the state Justice Department and Douglas added that if charges are filed, they will be handled by Lancaster County Attorney Mike Heavican. "Although the investigation by the State Patrol has ended, I will continue own examination of the situation next week," Benson said, promising to advise the public of any more disciplinary actions. He continued to interview several lieutenants Friday afternoon. Benson said Diagnostic and Evaluation Center Superintendent Gary Grammer will become acting warden at the penitentiary until a new warden is named. Ken Liggett, program administrator at will fill Grammer's vacated post as acting superintendent.

Benson named Maj. Barry Loock as acting associate warden and Capt. Robert Greenwald, formerly second-shift commander at the penitentiary, as acting major. The major's post is that of security administrator, under Loock and in charge of the three shift commanders. Vacancies left in one associate warden's post and in the executive assistant's slot will remain unfilled for now, said John Dahm, director of adult services for the Department of Correctional Services.

Pen needs 'new direction' Gov. Charles Thone said Friday the most recent shakeup within the state prison administration helped point up the need for an "entirely new direction" in Nebraska corrections. Commenting on the resignations of Warden Robert Parratt and others from their posts at the Nebraska State Penitentiary, Thone said he did not believe the staffing changes would jeopardize prison security. He said he believes Correctional Services Director Charles Benson "has things well in hand." Thone said he and Benson had discussed the security issue "very seriously" and believed "this (action) poses no threat to security." "I've got full confidence in Charles Benson's leadership," Thone said. "He's a compassionate, but strong leader.

"I think he got to the bottom of this problem and handled it very well," Thone said of the director. The governor said he had met with Benson "five or six times" in the course of the probe, which began shortly after Benson was hired last September. He was 56. Seals was sheriff for years before resigning in May 1981 for health reasons. He moved to Nebraska City in 1967 and was chief engineer and program director for KNCY 1 radio station before being appointed sheriff. A native of Tulsa, Seals was a World War Navy veteran. He was member of the Nebraska City Masonic Lodge, Elks Club and First Christian Church in Nebraska City.

Survivors include his wife, Virginia; sons, Randall Monmouth, and John Nebraska City; daughters, Mrs. Patrick (Joyce) Roddy, White Bear Lake, and Mrs. Gregg (Jeri) Weigand, St. Paul, mother, Loretta Seals, Murfreesboro, and brother, John Murfreesboro.
