those responsible for submitting to the people of the state the four constitu tional amendments to be voted on August 1 it would seem that there is now practically no one to spon sor either except that pertaining to the judiciary It is true that here and there we find some member of the legislature or the senate commending all four and asking the people to support them but of course that is natural as these very am fellows are responsible for the submission of the same and the form in which submitted The governor of this state in a very lengthy pronouncement appearing in the state papers of date July 37 devotes his whole effort to the Judicial amendment leaving the others as it werfe to sink or swim The two high points stressed by the governor are that it provides for an Increase in the Supreme Court membership from three to nine and that therefore much more business can be dispatched and that the opinion handed down by any member of the Supreme Court of nine will be the last word and the law of the land and precedent for the other courts to follow whereas under the commission system the opinions of the Commission of Appeals is not authority in any court of the land except when Invoked in the particular case in which the opinion was handed down Furthermore that the adoption of the amfsdment will permit the rotation of district Judges and the sending of a Judge from a district where there is little business into a district where the docket is crowded in order to dispose of the accumulation Mow believe those are the two points most stressed by those voting ave This article win therefore be restricted to replying to those two arguments on the grounds stated and wiU not go afield in the discussion As to the first: when the legislature provided for the Commission of Appeals to assist the Supreme Court there was no limitation placed on their activities except that the Supreme Court would assign to such cases for their consideration as it saw fit and their opinions hould be reported back to the Supreme Court The legislature did not attempt to say that when an opinion was returned into court by the Commission of Appeals and approved by the Supreme Court that such an opinion should be of no force and effect except in the particular case on which the commission was writing but it was these -tion of the Supreme Court itself speaking through the then chief justice Ur Nelson Phillips that practically destroyed the value of the finmmiiBHnw of Appeals when it laid down that rule Had the Supreme Court seen fit and followed out the and intention of the legislature and permitted the opinions of the Commissions of Appeals to stand as the law of the land when approved by the supreme court itself the condition which now exists would not have been brought about and the Commission of Appeals opinions would have had the same dignity as those written by the Supreme Court itself The Legislature provided twocom-missfamers to assist the Court of Criminal Appeals and them commissioners with the court itself and all cases submitted into the Court of Criminal Appeals are heard by the court and the two commissioners sitting in banc and when an opinion is written by a commissioner and approved by the court it is of as much weight as if written by the presiding justice himself You never hear a lawyer when presenting a case to any court distinguish between an opinion written by a commissioner and one written by member of the court itself The Supreme Court can any time it sees fit recede from the position it assumed under Judge Phillips and take the same course as dot Court of Criminal Appeals and permit the commissioners of the Supreme Court to sit with the court and hear arguments in banc and then when an opinion is written oy a commissioner and approved by the Supreme Court hold that such opinion is a precedent for all purposes and in all cases as is the situation in the Court of Criminal Appeals Yes the legislature itself believe could so provide by statute Now in regard to the rotation of district judges alluded to heretofore The legislature prescribes the territory embraced in any judicial district and therefore a district judge my have added to his district more territory or have the same reduced at any term of the legislature Therefore to meet the argument put forth by the proponents of the amendment on this point Let the legislature have the political courage to redistrict this state from center to circumference and in those districts where the docket is too heavy detach some territory and attach it to those districts where the work is too light and where the trial judge has little to do in other werds by reducing the territory returnable to a given district court curtail its work and by adding to the territory returnable hr another district add to the wok of the trial judge If this Is done can you perceive of any reason for taking an Itinerant and non-resident judge and sending him into a district to meddle with the docket of the local judge Nay verily in my humble opinion the purpose and effect of the amendment is to largely take away from the people their right of
