None of the cases recently decided on abortion deal with the issue of hospitalization and that will be left to the three-judge panel which consists of Judge Robert A. Sprecher of the 7th Circuit U.S. Court of Appeals in Chicago; Chief U.S. District Judge Jesse Eschbach and U.S.

District Judge Allen Sharp. In 1976, the same three-judge panel, following Supreme Court edicts, voided most of Indiana's abortion law as unconstitutional on a lawsuit filed by Dr. Lewis. In that case, the court withheld ruling on the question of hospitalization or viability, but said states cannot require a woman to obtain the consent of her husband, or in the case of a minor, to get the permission of her parents or guardian to obtain an abortion. In arguing against the constitutional challenge, Lake County Prosecutor Jack Crawford and Deputy Indiana Attorney General Joseph N.

At issue is whether the State of Indiana has the right to regulate 'when and where abortions can be performed.

Under Indiana law, a physician is prohibited from performing an abortion when the woman Is In her second trimester of pregnancy unless the abortion is performed in a hospital and before "viability" of the fetus. Viability is defined as that period when a fetus can live a sustained life outside the mother's womb on its own with or without life support systems. Challenging the law is Dr. William R. Lewis, the head of Gary Northwest Indiana Womens Services, and a young woman identified only as "Mary Roe," who claims she can't afford to have a second trimester abortion performed in a hospital.

Lewis wants the court to strike down the law and the criminal Eenalities attached to it to enable lm to perform second trimester abortions in his Gary abortion clinic. Lewis' attorney, W.
