LITIGATION amily of ormer ire Chief Is To Receive No Compensation Decisions handed clown fiom the Supreme court of North Carolina as reported from Roleigh today con tained the case of Neely against the City of Statesville finding no error This was a case in which the estate of the late Chief Neely against the City of Statesville asking for award on the ground that Chief Neely died from accident while on duty 'The Industrial Commission made an award which provided that the family of Chief Neely shall receive the sum of $18 a week for a period of 322 weeks This case was appealed from the Industrial Commission to the Superior court and Judge Rousseau reversed the decision of the Industrial Commission ruling that the deceased died from heart failure and not from rccident This ruling was appealed to the State Supreme court and the highest tribunal sustained the de cision of Judge Rousseau which means that the estate of Chief Neely will receive no compensation Republicans Control Assembly Party Returns to Power In New York Assembly or Third Straight Year Returns Mount Albany Nov 4 New Yorl Republicans returned to state as sembly control for a third straight year jubilantly scanned slowly mounting returns today that pointed to a similar in seating a maj ority of delegates to the 1938 con stitutional convention They emerged from heavy balloting with 85 assembly seats largest majority in seven years and nine more than the bare 7G work ing margin they held this year as against the 61 and the American Labor four the latter represented for the first time Eighty five delegates are neces sary for a convention majority DAVIS HOSPITAL PARKING LOT WILL BE PAVED The Gilbert Enginering Company uas begun grading the Davis hospital parking lot across from the hospital on the north side of West End ave nue This lot has been used for parking for some time but the Davis hospital is now having it paved The lot to be paved has a frontage on West End avenue of 90 feet and a depth of more than 500 feet Paved approaches will be built and a system of parking will be marked off so that the entire space can be used for parking by guests and visitors at the hospital MRS Spanish non intervention committee was con vened today to authorize Britain to solicit cooperation in Spain toward withdrawal of foreign troons while London wooed the insurgents for trade favors Britain with a rearmament hunger for raw material such as rich deposits of mercury iron copper and pyrites was seeking commercial con cessions at the expense of Italy and Germany long standing supporters of insurgent General ranco Negotiations for trade agreements between Britain and insurgent Spain were renorted nearing completion The 27 nation neutrality committee was optimistic of making a tangible move at last toward withdrawal of foreign soldiers from the Spanish con flict although there was not complete harmony on the British non interven tion plan i It was expected the committee would authorize an approach fb both the Valencia government and ranco regime to solicit cooperation in the withdrawal plan Both most ardent pro ranco newspaper Daily Mail and most enthusiastic pro Valencia news paper the Daily Herald said Britain was convinced ranco would win and apparently was losing no time to jclimb belatedly on the bandwagon Court In court Monday after noon Carl Elam for abandonment and non support of his Ayife drew two years on the roads but after serving three the remaining 21 months are to be suspended for dive years on condition defendant re mains of good behavior and provides adequate support for his wife Lee Blevins and his son Donald Jllevins were charged with assault with deadly weapon with intent to kill in connection with a recent as sault on Paul Troutman There was not sufficient evidence that a deadly weapon was used therefore the court found Lee Blevins guilty of simple assault and his sen Donald guilty of aiding and abetting in the assault The father and son each drew 30 days on the roads but they gave notice of appeal and their bonds were set at $100 each for appearance at the Jan uary term of Iredell Superior court Mott Bustle charged with possess ing liquor for the purpose of sale wasfound guilty of aiding and abetting in the possession of liquor for sale Prayer for judgment was continued for two years on condition of good! behavior and on payment of the costs Eugene Gibson colored possessing liquor for sale prayer for judgment continued for two years on payment of the costs In connection with a recent mveteri ous automobile wreck on the hill this side of Barium Springs Edward lower's and Lewis Massey colored were charged with reckless driving A verdeit of not guilty was returned in the case of lowers and the solici tor nol pressed the case against Lewis Massey An old suspended judgment against Joe Brewer was brought up when it appeared to the court that Brewen had been drunk since the former sen tence was passed Brewer drew 30 days on the roads but this sentence was suspended on condition defend ant does not violate any of the laws of the state Court recessed until riday No vember 5 when the regular weekly docket will be disposed of Recorder's court will not meet next Monday November 8 on account of the open ing of Iredell Superior court on that date Tire regular weekly session of Re court was held Tuesday David Everett Dellinger was charg ed with reckless driving But after the evidence was in the solicitor nol pressed the case on condition defend ant pay the costs of this action A number Spain Taxation Problem Arises in Connection With Social Security Washington Nov 4 One phase of the social security act which an ad visory council may consider tomorrow is possible taxation of some persons for old age benefits The council six representatives of employers six of employes and 12 of the public will recommend changes in the social security act if it decides any are needed The group was ap pointed by senate finance committee and social security board The taxation problem arose be cause under present law an employe paid by two or more employers dur ing a calendar year is taxed or In ederal Court A case from Catawba county was compromised in federal court here Monday afternoon after which the court recessed until the third Monday in December The only case considered this week in the United Slates Court was brought by Abernathy of Cata wba County administrator of Ralph Setzer against the Southern Railway the plantiff asking damages in the sum of $25000 for the death of Ralph Setzer who was killed at a crossing in Gaston county in 1934 The case was compromised the plantiff agree ing to accept $200 instead of the amount called for in the suit Mayor Court Dr Goode Mayor Protein presided over the weekly police court Monday night in the absence of May or Shelton There were 2L cases of violations oi new traffic code most oi those cited forfeited their casli bonds assistant farm agent for Iredell county was elected assistant county agent for Rowan Monday evening at a joint conference of District Agent Altman of Raleigh and County Agent Sutton of Rowan Mr Wood announced today when asked about the matter that he had not made up his mind as to whether he would accept the position in Rowan He was elected to succeed Leagans who recently resigned to become farm Ideal Journey Through The Medium of The Cinema Mr red Slanc Jr Takes Mem In rs to Colorado Springs Yellow stone National Park Grand Can yon and Catalina Island During the program of Rd'ary luncheon at the Grace hotel club members journeyed briefly through the medium of the cinema to Colorado Springs Yellowstone Na tional Park Grand Canyon and Cata lina Island an ideal journey minus all the weariness and discomfort of travel These pictures were taken by a member of the Rotary club Mr red Slanc Jr on a trip through the West in recent months They were shown by Mr Slanc who was program chairman yesterday In all the beau ty of the natural coloring Rotarians saw the Colorado mountain landscape the rich reds of the sandstone in grotesque formation in and around Colorado Springs the deep blue of the Pacific around Catalina contrast ed with the vivid tints of the flowers in the gardens or colorful scenes along Loveliest of all were views of the Grand Canyon with its changing pur ple shadows and a red sunrise seen from the canyon's rim Mr Slanc evidently has fondness for waterfalls for some of the most interesting pho tographs were of these ranging all the way from the shining silvery threads of small mountain waterfalls to the grandeur of the alls of the Yellowstone Views of trout at play in mountain streams excited keenest interest among disciples of Izaak Walton Mr Bunch
