Charles Whitlow was awaiting rd today from Oklahoma authorities concerning the extradition of a second suspect in a capital murder ease Robert O'Neal Jr 17. who was apprehended near Enid. Okla Saturday night, was to appear before an Oklahoma judge today and could waive extradition and be returned immediately.

Whitlow said. O'Neal is accused of involvement in the July 6 killing of Ralph Roscoc Sharick. 78. at the home of his son-in-law. Dr J.

Kinney will determine whether the Aarctic Heating and Cooling and Plumbing 1332 N. Stewart, was in violation of OSHA safety regulations when a sewer ditch collapsed Thursday killing John Ray Martin, 22. Oark. and (ieorge Sojka, SI, of 3211 Dayton. Greene County deputies are conducting a follow-up investigation, apt.

Charles Whitlow said. Carl Astley of OKI! A 'a Kansas City Office said Kinney probably will file a report with area director Robert Borchardt later this week. Borchardt ultimately will determine whether the Aarctic will be cited. Depending on the results of the investigation, the company could face a fine. Kinney, who was en route to Springfield from Kansas City this morning and could not be reached for comment, will test the soil at the accident site in the 4000 block of South Sherwood Road.

He will interview witnesses, including job foreman Wayne Chronister and will talk to Aarctic owner Robert D. Jones, Astley said "OSHA will find out the facts here and that is all I want," Jones said. "I've been in business quite some time and I've never had a serious accident We are a union shop and we hire qualified men." he said. Sojka had been a member of Plumbers and Steamfltters Union Local No. 178 for II years, union president Jack Bowman said.

Martin applied for a union membership Aug. 21. "This was his first job" with the union. Bowman said. The union will pay death benefits to Martin's family "It'a the right thing to do," Bowman said.

Aarctic had signed up as a contractor with the union on June 18, Bowman said. Aarctic is subcontracted with Bramer Construction Co. to lay the sewer line for the new Jamea Jeffries Elementary School. Astley said Aarctic would be directly responsible if the inspector determines the Job site violated safety standards. Bowman said the primary responsibility for safety at a Job site "is shared with the contractor and the people" working the job.

"Anytime you work in any place unsafe, you have the legitimate right to protest." Sojka and Martin could have refused to work in the sewer ditch and the union would have supported them, he said. L.A.
