J'' i FRANKFORT, FEB. 1J 4 A. M. (SPECIAL) DR. M'CORMACK SAYS GOV.

GOEBEL IS STILL IMPROVING AND THOUGHT HE NOW HAD AN EX- CELLENTCHANCETO RECOVER. GOEBEL MADE GOVEBJTOIL The Legislature succeeded In evading Taylor bayonet and In holding a Joint cession at Frankfort last nighty The report of the Contest Bcmrds. declaring that William Goebel had been -legally elected Governor, and that J. C. W.

Beckham had been legally elected Lieutenant Governor, were adopted. A quorum of the member" of the General Assembly was present, and the reporta ere unanimously adopted. At 8:30 o'clock the oath of office administered Mr. Goebel by Chief Justice Haselrlgg. and he became Governor of Kentucky.

Mr. Beckham wm also worn in by Chief Justice Hazelrlgg. Gov. Goebefs first act was to issue a proclamation ordering to their. homes the regiments of the State Guard now In Frankfort.

The meeting of tire Legislature waa accomplished with the greatest difficulty. Taylor's troops barred the way to the legislative halls when the members attempted to assemble at their regular hour. They were informed thai the Actios; Oovernor had declared a state of Insurrection to exist and had Issued a proclamation declaring he Legislature adjourned to meet again next Tuesday at London. county. The members of the Legislature.

not rt cognizing any authority on the part of the Acting Governor to adjourn 1 them, theu attempted successively to nn-et at the opera-houje and the court- bouse, but were confronted at each rla-ce bjr Frant fort "waa umTeT fcayoneljole. and even tb Capital Hotel, where Mr. Goebel Uy apparently was surrounded and Its halls Invadt by troops. In spite of this, Legislature found a meeting place at night, anil acted with due re-Card to all the forms of law. and Goebel became Governor.

I recov Gov. Goebel still hovers near death, "but with a better chance for ery. During the afternoon he believed to dying. Early In the night he rallied and his physicians thought the slendrr chance of recovery was gnmewhat better. Later in the night he was resting well and his phy-si ianj thought he would unquestionably got through the night, flis tiun of coolness courage Is little short of marvelous.

With death- looking him in the face, he counseled with the meinlu-rs of his party, urging coolness and strict adherence to the law and writing out for them since he was forbidden to talk much directions for proceeding. His directions were followed to a successful result. The news that Goebel had been sworn In as Governor threw the Republicans Into consternation. The guards about the State buildings were doubled, and hasty consultations were held. It Is probable that Injunctions will be served on Taylor and Marshall this morning.

Many of the Republican members have left Frankfort. Intending to repair Cn London next Tuebdav fur a rumri salon of their own. Several prominent Republicans In the House and Senate v. expressed their disapproval of Taylor's assumption of authority In trying to adjourn the Legislature, and there may be some absentees when the rump aesslon la called to order, if it ever la led to A train of seventeen empty coaches went over the Louisville and Nashville through Frankfort last night bound for Eae'ern Kentucky. It Is presumed they are to bring back another crowd of mountaineers.

Democratic leaders at Frankfort i are urging "Democrats to tay awa. No reward has been offered and no search of the Executive building.

where the assassins were concealed, has been permitted. Since the shooting the '-Nl i fling lias swarmed, first with armed and then wltb on company troops neing quartered In the ante-room of the office. The oath of office was administered at o'clock to-night bjrChief Justice J. IL Haxelrigg. of the Court of Appeals, Gov, Goebel the while lying on his bed of suffering- with uplifted hand. "I do. said Gov.

Goebel In a firm tone, at the last word of the oath were said by Chief Justice Haaelrlst. "My one hope. said Mr. Beckham, atter takluf the oath, "la that I shall be only Lieutenant Governor for the- next four years, and God bless our Gov, Goebel." A Seen. Without Parallel.

The solemnity of the seen, at what may prove to be Gov. Goebel'. deathbed Is probably without parallel In the history of thH Commonwealth. John L. Helm was sworn In as Governor on his deathbed after the war, but under no such' circumstances as existed in that chamber to-night Dauntless, brave a-nd true even almost in the shadow of death.

William Goebel. the" statesman, the friend of the common people, and. aa some of his enthusiastic friends put It. "the man of destiny," did this day what seemed well nigh 'V Impossible for a human under such circumstance, to do. Still Leader of HI Party.

Though expected each hour to breathe his last, and with loved ones awaiting at his side, fearing yet' hoping against what seemed to be the Inevitable, this remarkable man calmly and with unerring precision retained the leadership of his party and dictated the line of policy which has made him Governor of Kentucky. Admonished by hi. physicians not to talk more than waa imperative, he with pale but steady hand wrote out hi. wishes while lying flat upon hi. back.

Hi Oounael. Wm. Carried Out. Those direction, aa to th. course that ought to be pursued in making legal and binding th.

contemplated act of th. General Ancmbly were followed to th. letter, and with full knowledge of I the procedure In joint session Chief Justic recognised It as hi. duty to administer th. oatia of offlc.

TAYLOR, GOVERNOR OF KENTUCKY, BY CALEB POWERS, SECRETARY OF STATE. complished not only In th. face of possible death, but while sui rounded by armed soldiers brought her. by Mr. Taylor to thwart th.

will of the people. Taylor Adjourn, th. Legislature. This last solemn scene In Goebel's room was the climax' of the most eventful day probably ever known In Kentucky. It began with the most disgraceful and most lawless proceeding, the first act being a proclamation from Mr.

Taylor to adjoirn the Legislature to meet In London, the metropolis of th. mountain feud country, on February But In this he overshot th. mark, and it Is conceded even by the ablest Republican lawyer, that be misconstrued th. Constitution, a. is shown by th.

unanimous decision printed below as reached at a conference attended by Judge W. S. Pryor. ex-Oov. James B.

McCreary. Mr. Louis McQuown and other able lawyers. The proclamation of Mr. Taylor waa read from the inside step, of th.

General Assembly building by Adjt Collier, who with his soldier, held at bay th. member of the General As sembly, who In a body had marched to th. hail at lbO o'clock. Than Began a Chase. Speaker South Trimble mounted the steps and adjourned the session to the Opera House.

Then for a half hour there was a continued chase of the General Assembly by the militia, who headed off their entrance first into the City Hall and then into the courthouse. Tried Session. In the Street. Twice within thirty minutes were aea-slon. of the General Assembly held In the middle of the street, twice were they ordered to disperse, and then warned that any meeting would be regarded As an unlawful assemblage and would be broken up by Midlers.

Th. spectacle of nearly a hundred member, of th. GeneraAfcssembly run-nlng In a body through' the middle of the streets chased by companies of militia, on the double-quick is one seldom wltneased. and It la no wonder that hundreds of citlzens rushed to their doors and windows, their eye. gllsten-(Concluded On Fifth Paga.

While death seemed often to hover near William Goebel during this day of anxiety, he yet survives and may Hve to enjoy the honor which the General Assembly to-night declared had been conferred upon him by the people at the polls In November; A braver struggle against death waa never made, and a splendid physique, backed by Indomitable will-power, has enabled Gov.

Goebel to endure what th. noit physician in this notion of the country declared to almost impossible, for It will be recalled that last night they said his chances for life were one out of hundred.
