Hold-Ups Operating in Caldwell A dispatch from Moscow says: Judge Piper when court opened yesterday morning rendered his decision on the constitutionality of the age of consent act passed by the legislature of 1895 under which McGraw is being prosecuted for criminal assault Although there was some slight irregularity with regard to the record of the bill as shown by the certified copy presented by the defendant's attorney they were no such defects in its passage as shown in that of the fee bill which was cited as a parallel case The irregularity was not such in Judge Piper's opinion as to render the act unconstitutional and void After rendering the decision the trial of the case was resumed All the testimony for the prosecution and the defense was submitted before adjournment Florence Cartwright the 15-year-old victim of the alleged assault was the most prominent figure Her 5-months-cld child was in her arms during the giving of part of her testimony Her testimony was explicit as connecting the defendant with the commission of the act She stated that she consented under promise of marriage The defendant testified in his own behalf that he had gone to the girl's home for the purpose of committing the act hut on being informed by her that several had already been crimi nally intimate with her abandoned his purpose through fear of unpleasant consequences TERRIBLE ACCIDENT Richard Lashbrook Killed in a Kootenai Sawmill Coeur d'Alene Press Last Tuesday just after the dinner hour a telegram was received here stating that Richard Lashbrook son of Mr and Mrs Lashbrook of this place had been killed in (the sawmill at Mnd lake near Hauser Junction The mill had jnst started np after dinner when the accident occurred and it is supposed that the young man stooped over the saws to remove a sliver of wood and that his slothing caught in the rapidly revolving saw His head was cut open from ear to ear and there were several other severe cuts on his face and arms Death was almost instantaneous CALDWELL HOLD-UPS Attempt Made on Simon A Howard Touched Caldwell is infested with a gang of hold-ups The Record reports that an unsuccessful attempt was made to hold up Simon proprietor of the Caldwell Clnb saloon Two masked men entered his place of business about midnight and covering him with revolvers ordered him to open the safe The Record continues: "They re peated their demand in emphatic terms and Simon again gave them a similar answer at the same time making a dash for a water Ditcher under his counter as the handiest weapon of defense He shouted in loud tones at the invaders This unexpected turn in affairs evidently disconcerted them and they began to retreat Mr Simon pursued them with the pitcher and hurled it at their retreating forms as they disappeared through the rear door'' yelling brought an officer to the scene but the two "bold" bandits had fled leaving no clue The night before A Howard was held upra lone horseman near Caldwell and relieved of 98 HIS EYES BLOWN OUT Thomas Hoyt the Victim of an Explosion of Giant Powder Baker City Democrat The news of a horrible accident befalling a miner employed at a mine on Quartz gulch in the Granite district has jnst been received here On Sunday evening Thomas Hoyt the victim was at work drilling a hole for a blast and was tamping the hole when an explosion took place that came near blowing him off the face of the earth When found and an examination of his injuries was made the awful reality was only too apparent that both his eyes had been blown out He was injured externally also but his life was spared The fatal shot was from a missed hole and the tamping caused the concussion Hoyt was taken to Granite on Sunday night for medical assistance The
