Domlnguez During the period of time between June 15, 1976, and Nov. 23, 1976, we were engaged as authorized dealers for Miracle Maid ceokware. The mode of operation was as follows: dealers booked dinner parties, cooked and demonstrated at same and followed up with sales calls to the homes of the attendees.

We reported directly to a district sales manager, had training evenings two nights a week and a business meeting one night a week. All our paperwork concerning sales and presentations were turned into the district manager for processing with the company On a cash sale we retained our commission at the time of sale. On a budget or finance sale we sent in the deposit and the company was supposed to pay our commission as soon as the credit was cleared for the sale. The preponderance of our sales were cash. Our grievance is about credit sales.

We have not been completely paid. Maurice E. Singer, Canoga Park Accompanying your letter to us was a substantial file between you and Miracle Maid's headquarters in West Bend, which showed you were seeking a commission of 1112.14, while the company claimed that money was withheld as a lease for your equipment, sending you a check for $19.77. You felt you had already paid for the lease on your first sale. Our letter to Miracle Maid prompted the-issuance of your check for the full amount of $112.14.

The explanation was that a recent change in management brought a change in philosophy on situations such as this. I would like to know about a summer camp for boys 9 to 10 years old. Could you give me a list of names, prices and where to get in touch with them? openviine On Aug. 20, 1976. a friend of mine took me. as a guest, to the World For Women Health Club and Spa in Sherman Oaks. I was impressed by the facilities and inquired about joining.

I spoke with Eileene Gray about my particular situation which required that I leave the country on business for an indefinite time. She assured me that if 1 joined then I could use the facilities before my trip and that I only had to call and tell her when I was leaving and she would reschedule a new starting date for when I returned. Eileene told me this in front of my friend. I joined on Aug. 21, 1976, used the facilities twice and called Eileene to tell her of my travel plans.

I gave hera tentative new starting date as Dec. 1, 1976. Business kept me out of the country longer than expected until the end of January. When I returned I had more traveling to do and did not return to the Los Angeles area until the middle of February On Feb. 20.

1977. 1 went to World for Women and asked to talk with the manager to adjust the Dec. 1 starting date. Madonna Nelson, the manager with whom I spoke, stated that she had no intention of honoring any kind of new starting date and that my membership would be terminated on March 20. 1977.

Later that day. when I tried to use the club facilities. Madonna said that I was on "absentee" time and would not be allowed to use the facilities. I told her that I had paid S165 and was entitled to use the facilities. Madonna told me that unless I dropped my claim for a new starting date she would not allow me to use the club.

In view of the way I've been treated. I would like my S165 refunded. Mrs. Yvonne TanchucK. Sherman Oaks When we made our first call on this matter, we were told that the money had been refunded to you and sent to your business address in Hong Kong.

Why this was done nobody could answer. Our followup call got us to Madonna Nelson who told us she was unfamiliar with the problem but would check into it. She told us, though, that there are no provisions for absenteeism in a six-month contract. When we heard again, she told us that a complimentary six-month gift certificate has been granted you for use of the club's facilities and that no refund was granted. Although World for Women feels it owes you nothing, the gift certificate is a gesture of the spa's being "doubly fair," she said.

You repotted that you want no further dealings with World for Women because of the treatment you received, and will settle only for a cash refund. That's the way it stands. Our advice to persons who purchase goods or services by contracts is to get all the salesman's promises in writing on the contract.
