The salary cap puts a ceiling on the total amount of money a team can pay its players. The cap has increased from $3.2 million to $6.1 million per team in three years as NBA revenues jumped dramatically. Fleisher also wants the college player draft abolished. "They're not willing to abolish any of the (three)," said Jim Paxson. vice president of the Players Association.

"They're willing to make modifications, even in the draft, but our position still is we want all three abolished." There have been reports that the two sides have discussed the possibility of giving each player a one-time opportunity during his career to sign with any team without any restrictions. Associated Press NEW YORK Contract talks between the NBA and the players association have been on hold for nearly a month after the two sides reached a stalemate over the union's demands that free agency be expanded.

The two sides have not met since July 15, and no talks are scheduled because Larry Fleisher, head of the Players Association, said he saw no reason to return to the bargaining table because of the owners' position. "Right now. they're unwilling to change the three major restraints to free agency." Fleisher said, referring to the salary cap, the right of first refusal and the NBA draft. "That's the reason we haven't been talking. There's no reason to talk at this time." The NBA's chief negotiator denied yesterday that the league has refused to change its position on the three major issues.

"We've offered what we think are very substantial modifications in the system, but we're not willing to throw out the whole system," said Russell Granik. executive vice president of the NBA. A stalemate developed during the July 15 meeting in New York after the two sides discussed the right of first MESA. Ariz. Drug charges against former Phoenix Suns forward Garfield Heard were dismissed by a Superior Court judge yesterday at the request of the prosecutor in the case and Heard's defense attorney.

Heard, 39, was one of five current and former Suns players indicted last April on drug-related charges. Dismissal of the one-count indictment against Heard comes two months after a judge ordered the matter sent back to the grand jury for a new hearing. Neither the remand nor the dismissal order, yesterday by Maricopa Superior Court Judge Grant Woods contained an explanation or reasons for the moves. Woods' order said the charge was being dismissed without prejudice, meaning prosecutors can refile the case. However grand jury transcripts and other court documents indicate prosecutors may not have been able to prove charges against the former player because a key witness against Heard changed his statement after the indictment.

Heard had faced a felony charge of conspiring to traffic in drugs, which carried a maximum penalty of 14 years in prison and fines of up to $150,000. It prompted Phoenix Mayor Terry Goddard to request Heard's temporary resignation from the mayor's task force on drug abuse. Heard, a real estate broker with Del Webb Realty and Management, retired from basketball after the 1979-80 season, his fifth season with the Suns. According to grand jury transcripts and the police investigative report obtained by the Tribune, the charge stemmed from allegations made by Suns all-star Walter Davis and Suns ticket representative Alvin Scott. Davis, who gave grand jury testimony in the case March 24 under a grant of immunity, told the panel he was introduced to cocaine by Heard during Davis' second year in the league while the team was on a road trip to Cleveland, according to grand jury transcripts.

Later, in a sworn interview with police and prosecutors on March 30, Scott said he used cocaine with Heard in a hotel room in Seattle several years ago, according to the police report. But in court documents filed in June, Deputy Injured Indiana Pacers forward Clark Kellogg, a rebounding force in the league when he was healthy, yesterday announced his retirement from pro basketball. Kellogg cited his injuries as the reason for his decision. County Attorney James Keppel said Scott has changed that story On May 21, Keppet wrote, Scott signed another sworn statement "denying that Garfield Heard used cocaine with him and had supplied him with cocaine in Seattle." On May 29, responding to a request by Keppel and Heard's attorney, Tom Henze. a judge sent Heard's indictment back to a grand jury for a new hearing.

Only 10 of the 13 people initially indicted in the case still face charges. Last week, the indictment against William Merriweather was dismissed after a judge said it would be a "grave injustice" to prosecute the roommate, former Suns center William Bedford for obstruction of justice in the case. The week before, prosecutors agreed to drop drug trafficking charges against a Tempe restaurant manager when the man agreed to plead guilty to a lighter charge and receive a probation sentence. And one of the three charges against Suns center James Edwards was sent back to the grand jury after a judge ruled that police gave "inaccurate" information to the grand jury in the case. Three other indictments were dismissed earlier when the key witness in those cases, former Suns player Johnny High, was killed in a car crash.
