contested validity of the law in a test suit aganist Silverthom Lincoln county treasurer which was appealed from' district court The Seventeenth Legislature passed the law with a view to elim inating evasion of taxes' on such intangibles as stocks bonds money on deposit and promissory notes Old higher rates which had caused taxpayers to evade the tax were repealed and a new rate from two to four mills on the doilar was substituted Legislators approved the law on the theory that the lower rates would cause more taxpayers to make voluntary returns and thus increase the amount of collections i Love backed by a Chandler tax league instituted the suit by making a return of a promis sory note and demanding that Sil verthom assess it under the old law and certify it as exempt from other taxes The treasurer refused and Love sued for writ of mandamus He challenged a section of the new law providing that omitted property could not be assessed for back tax es after Jan 1 1940 and another
