A recent decision has been made in the United States Circuit Court, at Indianapolis, which interests the owners of the Holly system of water pumps, and cities using other pumps of similar character that are an infringement of the Holly patents.

"Some people have an idea," ays tbe Peoria Transcript, "that the Holly Water System, so-called, relates wholly to the rotary as those originally adopted by this city. This Is not true. "The Holly on which the inventor claims a patent, consists of forcing the water directly into the mains, without the intervention of stand pipes or reservoirs. The rotary pump forms no part of this system, any more than any other pump. Union City, Indiana, used some other pump, and adapted it to a system of direct pressure.

Mr. brought ac tion and obtained judgment against tbe ity, and a special master in chancery was appointed to award damages. An in unction was also ordered, restraining the defendant from further use of the system. The order for the injunction is In the following words Third That an injunction issued out of and an der ihe a jal of ihia court against the said defendant, immaudins It, it attorneys, agents, workmen, officers, servants and employes, to desist irom making, neing or v.n aai auy system or water-wo as. whereby the water is pumoed direc lv into the Witr mains, tbe apparatus for that purpose be-in supplied with contrivances Uice orsabstantialty like those shown and described in sail reissued iat.

Ansocscemest. Dr. J.

Munson will be absent from the city on the 4th and 5tb Patients will please take notice. I PORTA XT DECISION The State Supreme Court recently ren dered a decision that will prove interest ing to mortgagers and mortgagees. The case came np on an appeal from Plymouth county. A Mr. Julian wished to raise some money, so gave a mortgage on his threshing machine.

The mortgage coc talned the following clause "that in case of default made in the payment of the promissory note described in the mortgage or in case of any attempt to dispose of or remove from the county of Plymouth the aforesaid goods or chatties, or any part thereof, it shall be lawful for the mortgagee to take possession of the property and sell the same and apply the proceeds to tbe payment of the note." Mr. Julian obtaining woik in another counay, obtained permission of tbe mortgagee to move the machine out of the county in which the mortgage was given. Having once moved the machine out of tbe county, the owner was legally released fiom the stipulations of the paper. He at once moved farther away, continuing his travels with his machine InUi Kansas, where he sold it, and used the money for other purposes than the payment of the note. Suit was com menced on the note and was finally brought befcre tho Supreme Court where Judge Seevers delivered an opinion in substance as follows "Judge Seevers ruled that the property was not legally sold, yet the defendant could not be convicted for a sale unless the sale was made in Plymouth county, nor could a concealment of the machine in Kansas or Nebraska constitute or make a concealment in Plymouth county, where the mortgage was given." This is an important decision and raises a new point in law of interest to mortgagees.

THAT NEW CLOTHING IIuUSE. IloBley, raaraoHgbi Tracy. This new clothing bouse in Second street has been in operation about three months. It was predicted that they couldn't do anything here that the clothing business was already overdone, and that any new comer would find no customers. It has proved different.

The men knew what they were about, they took a good large, centrally located store, fitted it np nicely, filled it up full of good wearing app trel for men and boys they marked their goods at fair prices, and offered none that were net exactly as represented in quality and durability. Tbe people went to see them they found everything just "as stated "In the bills," they bought and were pleased and advised their friends and neighbors to go and do likewise. The result of it is that the members of this firm, and their active clerks, instead of having to set about waiting for customers, have found about all they can do from morning to night, wailing upon those who want really good goods, at the prices of the times. This proves that the trade was not overdone before, but that what was wanted was just aach" a Jiving, active, wide-awake firm as Hosier, Murdough Tracy, to come into the city with a full line of goods, with a broad experience In their branch of trade and with the determination to keep things moving. All this may be safely said of this house.

The people are glad they are here, and will bat con-salt their own best interest in keeping np the raid they have been running upon No. 125 Weit Second street. I DOINGS THE FOURTH. The pic-nic at the Fair Grounds under the auspices of the Catholic Ladies' Union will be the event of the day in the city, and the probability is a large'crowd will attend. The order of exercises is as follows Music (America) By Chorus Under direction of Prof.

The enterprising ladies having the project in charge are displaying much energy in making the necessary arrangements for the inauguration of tbe new institution, and of course they have succeeded most fully in their work. The public dedicatory ceremonies will take place at the new building on Friday evening of this week. On that occasion the doors will be thrown open to the pub lie for tbe first time, and no doubt a most beautifu and attractive spectacle will be presented in the large and elegant rooms of the new library. Mrs. Wing, president of the association, and other discrimina ting and pains-taking lady officials have been to much trouble to gel up a most ad mlrable programme for the opening night composed of exercises ia every way fit ted for the occasion, and which will be sure to please all who attend.

NOTES. Black ruffles of fine Brussels net pretty lor onm.s. n-rMr Canon crape shawls are cut Gp ana used for fichus and collarettes. Four Button gloves of undressed kid are suitable for the street. Black crape lines in folds and bows pretty for morning neck-wear.

Bias folds are very stylish for trimm ing dresses in thick materials. Drap d'Alma is one of the most elc gant materials for morning suits. White Maltese lace is greatly in do mand for fichus and neck ornaments. New ribbons are worn with three or four shades of color on each side. Bombazines trimmed with crape in flat folds are suitable for first morning.

Open work striped batistes are very stylish and require but little trimming. Horse shoes, bronzed and painted, make pretty ornaments to hang over the door. A late opening in Summer styles confirms the rumor that paniers are to be worn again. Large parasols, with heavy embroidery, in colors, are among the latest introductions. Stockings have gotten tbe bourette mania, and are shot with all sorts of brilliant threads.

Very little real thread lace is used, the French lace having almost entirely superseded it. Btaded clasps, for fastening wraps, draperies and trimmings, are among the novelties. Toile de Vichy is a very fine imported gingham, suitable for children's suits at the seasiae. For dressy toilets, the polonaise ia open in front and long in the back, forming a court trail. The shell trimming so much in favor is exquisite, when made of double-faced ribbons.

Linen dresses in gray buff and navy blue are embroidered in tho same shade button-hole stitch. Collars, cuffs, fichu and handkerchief in sets and embroidered in colors are generally admired. Street gloves of kid are of maslre gray, and have two buttons lisle thread have only one button. Collars arc straight and meet or lap, Those showing the throat are not consid-eredastylisb. Figured satin umbrellas are very popular for open carriages or for morning strolls in the park or country.

Spanish laces with very thick figures on very heavy grounds are much used for trimming reception dresses. The demaLd for camels' hair shawls the present season has been immense, much greater than for six years past. Satin ribbons, usually unpopular in summer, are to be very much worn, and are preferred in double-faced, each side a contrasting color. It is tbe confession of a widower who has been thrice married, that the first wife cures a man's romance, the second teaches him humility, and the third makes him a philosopher. Small hats are in favor, and are very much trimmed.

Indeed, there seems to be an inclination to keep upon tbe head all sorts of ornaments. Face trimmings are greatly in favor. Two styles of coiffures are in favor. One ia short-frizzed curls confined by bands of cold or silver or ribbon. The other with close crimped front and a thick plait or twist pinned close to tho head at tbe back.
