(AP) A band of young Negroes and white persons stayed in a Birmingham bus station in the pre-dawn hours yesterday, waiting to break racial barriers, while a crowd of white persons KNOXVILLE. Tenn. (AP) In a case which may make legal history, a federal court jury has ruled the United Mine Workers Union violated the Sherman Antitrust Act.

It wan the first time, as far as lawyers in the suit have been able to determine, that a labor union has been adjudged guilty of antitrust violations on a national scale. PENALTY The jury yesterday awarded a dustry and restrain trade, damaging Phillips. The case went to the jury Wednesday following a month-long trial. UMW attorneys said they would file a motion asking the court to set aside the jury's verdict and direct a verdict in favor of the union and the welfare fund. If the motion is denied, the attorneys said they would appeal.

The case stems from an action filed by the trustees against Phillips seeking $56,000 in back welfare fund royalty payments. Under the union contract, mines are required to pay 40 cents per ton of coal produced to the fund. milled around outside. terson had told a presidential aide that he has the "will and now reduced to 99 $799 $fl99 $9" MO equipment" to give full protection to all travelers in Alabama. as this Deep South city entered its seventh straight day of mounting racial tension. They tried to board three buses and ride integrated Thursday, but none of the buses left the station. Then they settled down in the white waiting room and said they wouldn't try again until daylight. They made no effort to board buses leaving late Thursday night and early yesterday. DRIVERS REFUSE The youths entered the station, carrying tickets to Montgomery, at 2:45 p.m., Thursday.

They said they intended to stay "until we get a bus to Montgomery." Drivers, apparently fearful of violence, refused to take out buses earning the integrated group. Buses for Montgomery weren't canceled when the group tried to board them They just didn't leave the station. The threat of violence remained, as it has since a white mob jumped the so-called "Freedom-Riders" of the Congress of Racial Equality last Sunday, and beat some of them unmercifully. The integrated CORE group was testing bus station segregation in the South. A crowd, building up to several thousand at one time, gathered in the area around the station Thursday night but it thinned out as the night wore on.

Phillips Brothers Coal a now defunct partnership, sued the union and the fund's trustees charging they conspired with large coal producers to monopolize the soft coal industry and force small firms out of business. The firm said the alleged began in 1950 and was carried out through the 1950 bituminous coal wage agreement, still the industry's basic contract.

While labor unions normally are exempt from antitrust laws, a Judge Robert L. Taylor put it in his charge to the jury, "if a union aids and abets businesses and firms" in attempting to restrain trade, the union comes under the jurisdiction of the statutes. LONG DELIBERATION The jury, after 2' days of deliberating, ruled both defendants conspired to monopolize the in in Alabama.
