The following resolution Offered in the City Conncil last evening by Aid. Shaw was unanimously adopted Baolced. That the City Attoraev be and he is hereby instructed to commence suit gainst the Davenport t. 1'aul Kail road Company, for tbe purpose of repeal ina- an ordinance approved Mav 11th, 1870, as the conditions of said ordinance have not been eompuea vntn by the said railroad company. The ordinance in question was adopted in good faith even hurried through the Council under whip and spur, under the representation that the faturo welfare of the city depended upon it that the life of the I St.

P. depended upon it that the -work was to be commenced forth- ith and that tbe rights of the city were to be respected. Two years anda half bars been fritter ed away, and to this hour tt is not known that any particular line has been adopted by the company. It is certain that it does not intend to comply with the ordinance only so far as it find it profitable to do o. The manufacturing interests of tho Eastern jart of the city, the ordinance was framed to protect.

Lave betn thoroughly ignored, so far as anything has bseu done moreover, in the proposed location of it line It ha aimed such blows at the growth and welfare of cer tain portions of the city as to place tho people as a unit in a position of antagon ism to its acts. In view of these facts, and many other, the city authorities, for tbe protection of the interests of the city sought to. bo destroyed by tho company, have felt impell ed to tuke this step as th commencement of vigorous action in self defense. Not that it is in any sense inimical to the I). St.

P. Iiailroad, but pledged to its suc cess but when its managers, regardless of the public wel, and impelled by motives thoroughly selfish and mercenary, assume to override the will of the people throt tle some of the dearest interests of the city erect man-traps for the destruction of life and property, to the end that a few dollars may be paved io tbe construction company, it is time that firm and deci ded ground be taken on the defensive time that the question of paramount rights as between the company and the city fchould be determined. Davenport has no war to make on this road or this construction party, unless compelled in self-preservation to make war. Davenport greets the D. St.

P. road, yet is unwilling to lay down its life, or cut a main artery in order that the D. St. P. party may grow fat.

In this view and spirit has the above action been taken not that it has enmity to the road, but that it would have the road so built into and through the city as to do no unnecessary damage. Better far that there be amity and good faith established without serious conflict. Even as the company electa so it will be. GOOD, WOVE. Investigation is a good thing, and it was a sensible move on the part of the City Council to appoint a committee of competent gentlemen to proceed to Chicago to examine into tbe merits of the Babcock Self-Aoting Fire extinguisher.

Aids. Cock, Bunge, Laverenz, Scott, and McClelland aro men of practical good sense, and will perform the duty assigned to them thoroughly. We hear some objections to this movement the principal of which is that it is a humbug. This would besufllcieut.were it true. We can recollect of the time when tbe magnetic telegraph was voted a humbug; when the steamboating and steam cars, and railroad were declared humbugs when the oeean cablei was put in the same list, ana many other highly useful inventions were so named.

The declaration praved nothing but the ignorance and bigotry of men who denounced without knowing what they were talking about. This fire apparatus is neither an exper iment nor a humbug. It is a rather recent invention to be sure, but has been thor oughly tested. The email extinguishers are endorsed throughout the land. They ave saved millions of dollars in property.

The extinguisher on wheels is the same thing on a large scale. The invention is purely scientific, and we believe the day is coming when it will be as universally doptcd as the steam car and the tele raph. DAVEJiPOUT T. PAI COMMIS 8ION. There seems to be a hitch in the com mission business of this road.

Sec.

11. Be it furUier enacted. That during the first five (5) years of this char ter, for each Ore hydrant located a here inbefore pnvided, and of which said city ball at all times have tbe free and unob structed use for fire purposes, the city shall pay to (aid companv an annual ren tal of eighty dollars (80) for each of said hydrant for the next term of five (5) years an annual rental of seventy dol lars ($70) for each of said hydrants for the term of five years next thereafter, an annual rental of fifty dollar and thereafter, during the existence of this charter, an annual rental of forty dollar ($40) lor each ol said hydrants payments to be made semi annually tbe rent of laid hydrant to commence as soon as S00 hydrants are ready for use. Skc. 12.

Be it further enacted. That said comptnr shall, during the life of its grant, lurnisii water free ot charge to all public! sohxls and to all building in said city and for fountains in each of the public parks therein, and at not less than three places in said city, for public wa tering troughs, to be locoted by the city. But for all water uned tor other purposes (except for fire and domestic use) ha said city shall piy the same rates as for domestic use, and said rates, whether for domestic or otherwise, shall be established at a uniform price for 1,000 gallons, as as practicable and ia consideration ot the foregoing provisions the said company during tne term of twenty -five (25) years shall be exempt from all municipal taxation on tbe franchise hereby granted, and all property owned by said company and actually required for the economical management of the words aforesaid. Sec. 13.

BetC further enacted, That in consideration ot tbe rights and privileges granted said company, tue said city re serves to itself tbe right at the expiration of fifteen (15) years from the date hereof to take from the company the entire work at a valuation to be then agreed on in the following manner, to-wit: By giving notice in writing one year before the expiration of the fifteen years, cf such intent, whereupon said city shall appoint two appraisers, said company shall appoint two appraisers, ana tne tour so chosen shall select the fifth the five so constituted hall proceed to value all the machinery, pipes, buildings, franchises ana material on hand, then belonging to said company, and the decision of a majority shall be binding both on the city and company. and on the payment of tbe amount so de termined, the company shall at once deliver to the said city all of said property. Should the city fail or neglect to notify at or before the time required, the same ight shall be extended, at the end of each five years hereafter, until the expiration of said grant, when the same method shall be adopted for the valuation of the machinery, buildings, pipes, franchises and material on hand, Provided, that if said city shall so purchase said works at tbe end of said 25 years tbe franchises granted said companyjierein shall not be ppraised, and shall not be considered by said appraisers in fiiirjgthe amount which said city shall pay for said works. ec. 14, Joe it further enacted, That on or before the completion of said works, or at any time during the ownership thereof, the city shall pass and enforce all ordinances, penal or otherwise, as may be re quired, and as is usual under similar circumstances for the protection of the property and rights of said company.

Sec. 15. This ordinance, when accept ed by the said water company shall constitute and be regarded as a contract be tween the said city ot Davenport and the said water company, and shall not be sub ject to amendment or repeal as provided in section 1 ot chapter 04 ot Kevisod ordinances. Sec. 10.

Be it further enacted. That the rates to be charged by said water company for water shall not exceed those charged in other cities similarly situated. FORMAL ACCEPTANCE. The ordinance having been formally approved by the council, the following acceptance was presented and read To the City Council cf the City of Davenport. Gentlemen.

I hereby for myself and my associates, accept the ordinance passed by your honorable body, this 4th day of December, 1872, authorizing M. Donahue and his associate to construct a system of Water works in said city ot Davenport for supplying water for fire protection and domestic use, and agree that the provisions, terms and condition of said ordinance shall be fully complied with and executed on the part of myself and associates, in consideration that said city shall fulfil and perform the obligations imposed upon it by the said ordinance. The city having accomplished its part for the present, Mr. Donahue will soon proceed to mature his plans for works, style of work, make pipe and machinery contracts, and organize a trenching forc4 At his own foundry and machine shops here, preparations are going on for the manufacture of some parts of machinery, making hydrants, casting unusual styles of pipe, etc. No time will be waisted in getting the work under way. Gay lord, of Cincinnati was, after the Insertion of the name of M.

Donahue, of this city in the place of that of Mr. Gaylord, and some minor amendments become a living char ter. That the public may ace precisely what tbe provisions of the ordinance we pre sent it in full as amended AN ORDINANCE to provide for the supply of water for the citizens of Davenport, Iowa, for domestic use and Are protection. Skctioh 1. Be it enacltd by the City Council of the City of Davenport Iowa, That there ia hereby granted to Michael Dona hue, and bis associates, who shall organ ize as a corporation nnder tbe laws of tbe State of Iowa, under the name of the Dav enport Water Compaoy.its successors and assigns, tbe exclusive privilege for twenty- nve () years, ana an equal privilege tnerualter with an others, or supplying the citizens of said city with water, to be taken from the Mississippi river at such point above tbe old railroad bridge as will best secure an abundant supply, both for domestic use and fire protection, said wa ter to be taken out of the river at such distance from the shore as will secure pure wrfter for domestic use.

Skc. 2. Be tt further enacted, That the said Davenport Water Company, its successors aud assigns, shall have during said term the right to use any street, lane or alley, in said city, for the purpose of laying down cast iron pipes, or other fixtures through saidstreets, lanes or no unnecessary lobstructions shall be permitted by said City Council, or by said com pa ny, and in laying said street mains all pipe shall conform to the grade cstab- ished by tbe said city, so that on tbe completion of said work no obstruction of pipe or other material shall prevent the ree use ot said street, lane or alley and the purpose oi r- piiring said pipes the ight, whenever neoessary, to disturb any street, lane or alley or s.dewalk. But shall repair tbe Fame with the material so disturbed, makeing ithe same in as good condition as before said pipe was laid. Src.

4. Be tt farther eutcled. That in case saia company rel uses or neglects to repair siul streets, lanes, alleys or sidewalks within a reasonable time atter said work is completed, and having been duly notified of such neglect by the proper officers of the said city, tbe Council may direct the necessary repairs of said streets, lanes, alleys or sidewalks, to be made at the expense of said company, and said company shall be responsible for all damages sustained by any person by reason of the negligence of its servants or employes while constructing and operating said works as above stated. Sec 5. Be it further enacted.

That the said company shall, upon their acceptance of tbe terms of this ordinance, proceed to make tue necessary contracts for machine ry, pipes, etc all to be made and delivered, and there shall be at least 17 miles of ipe laid, and the works to in full ope ration on or before the 1st day of January, IS, 4, ana ttiree miles more on or before the 1st of January, 1875. Sec. 6. Be wither enacted. That in the system of pipes for distribution of Water, said company shall lay down, on or before said 1st day of January, 1874, not less than 17 miles, and on or before the 1st day of January, 1875, not less than three miles more of main pipe, to be des- gnated by said city, of sumsient diameter to deliver the requisite amount of water for domestic supply and fire protection.

Be it further enacted. That said main pipe, to be laid by saidjcoinpany, to an extent of not less than twenty (30) miles, as provided in the sixth section of this ordinance, shall he laid in the following portions of this city, to wit Com mencing at Severn Brewery, on the river road thence running west on Front street to intersection of Third street thence west along said Third street to tbe western limit ot said city.

That th said company, its successors or assigns, shall extend said mains, and pipes to any part of the said city when requested so to do by resolution of said City Council provided, that said Council shall not di rect said company to extend said mams and piper beyond the limits occupied by said 20 miles of main pipes, except there shall be upon tbe street asking such ex tension, at least six tenements for eyery 400 feet on an ayersge of such extension, the occupant of which tenement shall first agree in writing to use ana pay lor wa ter furnished! said tenements by said com pany. i Sec 0. iJp it further enacted, That in the construction of said works, machinery shall.be used of such character and capac- sty as will furnish the necessary supply of water, excepting nnusal and unavoidable casualities, lor domestic use ana nre pro tection along said lines of mains, and that at all times in case of a sufficient pressure shall be kept up for fire protec tion, to throw six streams simultaneously out of one inch one hundred and fiftv feet below, or 100 feet above the bluffs.
