Mr. Hayes had 'been in declining health for the past two years and his death was not unexpected. Mr. Hayes was 82 years' oM April 27. He was the last surviving member of the family of the late William W.

Hayes and Mary Horn Hayes, they having passed away of years ago. Mr. Hayes was born and reared 1n i'redell county, having lived in this section until 17 years ago, when he moved to New Jersey to be with his children. He was united in marriage to Miss Bettie Gunn in the year 1873. To this union were born nine children.

His wife and seven children survive; five sons, Mr. W. F. Hayes, of Baltimore, and Messrs. A.

C. Hayes, T. L. L. and H.

H. Hayes two daughters, Mrs. Otto Peatersen and Mrs. J. L.

Messick, also of New Jersey. Mr. Hayes was in all respects a good man and his friends were made sad to learn of his passing away. He was one of The Landmark's faithful readers, always looking forward to its coming after leaving old Iredell. E. Fulcher, declared he had made a careful search in the meantime. The pistol was found in plain view niear the door connecting Libby' bedroom with the sleeping porch on which young Reynolds was shot.

Another apparently unexplained fact was the discovery of what seemed to 'be a bullet hole in the screen of the porch six feet six inches from the floor. Bullet Ranged Downward. Physicians testified the fatal bullet Reynolds' right temple and ranged downward, coming out below and to the rear of the left ear. Scott said it would have bee impossible for the bullet to have ranged downward through the head and then oipward through the. screen.

His only explanation of the apparent course the missile was that Reynolds was shot through the temple as he lay face downward on the bed with his left, side toward the screen. This theory assumed, of course, that the hole in the screen was actually made by the fatal bullet. Walker testified Reynolds was laying on the bed when the former first reached him.
