cent of the contamination. The EPA's evidence will be crucial in determining if Asarco can be held financially liable for the cleanup, the World-Herald reported. The EPA's technical work has done nothing to convince Asarco that the company is the primary source of contamination and should help fund any cleanup, company spokesman Bob Little said last week. The company's sampling points to multiple sources of contamina-, tion including gasoline fumes, paint and pesticides. Lead from paint is the primary source of the Omaha contamination, Asarco said.

Three other Omaha companies are being investigated as potentially responsible for the Omaha cleanup, Gunn said. Those are Union Pacific Railroad; Aaron Ferer Sons and Gould Electronics. Union Pacific has liability potential because at one time it owned and leased to Asarco come of the land where it operated. Aaron Ferer and Gould have potential liability for operating a secondary lead smelter, but their liability would be less because the smelter was smaller and operated for a shorter time period, according to the documents. The court documents stressed that most of the yards in east Omaha will not have their soil replaced.

About 16 percent of the yards would see soil replacement if current samples are an accurate reflection of the contamination. The cleanup's direct cost is estimated at about $96 million and could reach 134.4 million with the addition of indirect costs, Gunn said. That doesn't mean Nebraska's share of the cleanup will increase, he said. States are required by federal law to pay 10 percent of Superfund cleanups within their borders, but that figure doesn't include indirect costs, Gunn said. The Associated Press OMAHA Asarco's closed lead refinery is responsible for two-thirds to three-fourths of industrial lead contamination in Omaha yards, according to a copyright story published in Monday editions of the Omaha World-Herald.

The information comes from a document filed in federal court, the newspaper reported. The document also indicates it could cost $134.4 million to clean up the contamination, instead of the earlier estimates of $50 million to $100 million. The Justice Department has gone to federal court in Washington to block the company's proposed sale of its share of a Peruvian mining company. The government outlines in documents related to the case what it says is Asarco's nationwide responsibility for the cleanup of numerous contaminated sites. The documents include a 13-page statement by Gene Gunn, regional director of the Environmental Protection Agency's Superfund program, that details Asarco's potential liability in the four-state area including Nebraska.

Excessive lead is thought to be present in thousands of Omaha yards. The lead can endanger children's health, causing decreased intelligence, slow growth and behavior problems. Asarco has said its tests show the company is not the primary cause of Omaha's lead problems. A chemical analysis has matched lead particles from air monitors formerly stationed around Asarco to the lead in Omaha yards, Gunn said. The study linking the two remains under review.

Asarco operated a lead refinery in downtown Omaha for more than 100 years before closing it in 1997. The World-Herald reported the EPA says Asarco is a "significant source" of lead contamination in the city. The EPA document indicates the company is believed to be responsible for 65 percent to 75 per widow of Dr. William died Saturday (82402). Bom, Republican City.
