John Stuckwish of Alpine, was in critical condition and the transplant team was i in constant attendance at bedside 'in St. Luke's Hospital. The world's other three heart transplant patients still hospitalized were in satisfactory condition and improving. They included the Rev.

Jean Marie' Boulogne of Marseille, France, a 45-year-old Roman Catholic priest who became the world's 14th heart recipient in Paris Sunday. The 'other two were Frederick West, 45, who was making progress in a London hospital: and Everett C. Thomas, 47, of Phoenix, who was' in excellent condition in Houston. The only other living transplant patient is Dr. Philip Blaiberg, a South African dentist who was recovering at home after leaving the hospital March 16.

An unprecedented legal conflict was shaping up over the death of Clarence Nicks, 36, of Houston, the donor of Stuckwish's heart. Monty Bray, an attorney for one of the two teenagers charged with murder in Nicks' death, said: "There is a serious probiem as far as the legal-medical aspects of whether a man is dead if his heart still beats. It is incumbent on the state to prove the man is dead." Bray represents Alfred Lee Branum, 18, who said he did not "understand why they'd take his heart out like this and try to pin it now on me." Branum and Robert D. Patterson, 19, were charged with beating Nicks fatally in a fight outside a lounge April 23. Nicks died last Tuesday of massive brain damage, accordto an autopsy.
