GRAVE CHARGE IS BY A GIRL Bert Cutshall of Wallen Is Accused of Committing Crimfnat Assault A warrant was Issued this morning in the circuit m.rt for the arrest of Bert Cutshal), a married man twenty five years of age, who lives at Wat len and is employed In a saw mill there, charging him with criminal assault. The affidavit upon which was issued was filed with Prose, cutor Dawson last night by' Lsitha Ludwick, fifteen years of sge, who is the victim cf the assault Is the daughter of Scott ludwick and her mother is dead. In her statement to the prosecutor she said she was atone at home on Tuesday morning when Cutshall entered the house. and asked it her father or brother was there.

Shs answered that they were not and he seized her and committed his fell aiuult. For a time she was unable to rite, but. managed to get prepare dinner for her fatherr Nothing, was said to him of the, occurrence of the morning and the girl said she did hot tell because he is an epileptic and she feared he would fall in a fit. After her father and brother left the house she fainted and. felt upon the floor, 'remaining unconscious for more than an hour.

When she Anally recovered shs went about her house hold duties as best she could, but on the day following aha suffered tp euch an extent that John 'Bowser, a neigh, bor'and a man well advanced In years, asked her if she were ill. Sir. Bowser had performed a great many kindly acts for the little girl" and had won her confidence and shs related to him her awful experience of the day before. Her father was later informed, but the news so aBectel him that he was not able to come to Port Wayne with his daughter and she came in. with Bowser.

Prosecutor Dawson stated this morn, ing that the girl Is small for her age and related her story in such a way as to Impress him with the fact that sheLwas unsophisticated and he was compelled to ask the most dlreot questions in order to obtain any Information. In adldtlon to the story of the crime she told the prosecutor she is compelled to remain away from school on Monday and Tuesday of each week in order to da the' washing and iron lne for the family. She attends to the cooking and other household duties on the other days of the week, but manages to attend school between times. She said she knew Cutshall when he entered the house and, thought It ctrange that be came, but was given no intimation of his intentions until he seized her. Cutshall has a i wife and one child.

The man giving the name of Marcher said he was in charge of the gambling house over Pearse's and he it charged with conducting a gambling house. The same charge was preferred against Lew Brown and the others wers charged with visiting a gambling house. All gave bond for their appearance in the morning and were released. The patrol i wagon was not called to remove the prisoners to police station as, the horses were, tired on account of so many runs to aid the flood sufferers. Barnett as county coroner Dr. VanBuskirk served as hla deputy with singular acHity! He was a preceptor of Dr. Barnett, and a very strong friendship existed between the two physicians to the last Throughout his professional career Dr.

Van Buaklrk ranked very high as a physician, and he was frequently called In consultation by, other practitioners. Personally he wss most agre able and and his integrity was' of the loftiest type.
