He probably had choices, but he made the wrong choice, if the confession is accurate." Kachinsky said he has served as a prosecutor or defense counsel in more than 250 jury trials, and represented clients in more 350 appeals in state and federal courts. He said he has handled at least 20 homicide cases, and up to 30 including appeals.

31, 2005, the complaint says. After Dassey sexually assaulted Halbach who was naked and shackled to Avery's bed he and Avery killed the woman and threw her body in a fire pit to conceal the crime, according to the complaint. The affidavit says Avery bought handcuffs and leg shackles at Intimate Treasures, an adult retail store on Washington Street in Manitowoc, on Oct 9, 2005. A store employee said Avery was accompanied by his sister, Barb Janda, and that he paid cash for his purchase, according to the affidavit Halbach was reported missing on Nov. 3 and her partially hidden sports utility vehicle was.

found at Avery's Auto Salvage on Nov. 5, according to the complaint Dassey was charged last Thursday with first-degree intentional homicide, first-degree sexual assault and mutilating a corpse. He faces life in prison if convicted of the homicide charge and up to 72 Vi years in prison for the remaining charges. Avery, who spent 18 years in prison for a crime he didn't commit, described to inmates, in detail, his plans for a torture chamber he would build for "kidnapping, raping and torturing, and then killing the women," the affidavit says. Avery also allegedly told inmates "the way to get rid of a body was to burn them." One inmate told authorities Avery "was always talking about dominance or anger towards women," the affidavit says.

The affidavit to support the state's request on bail says Halbach had been to the Avery property numerous times in 2005 to take pictures for Auto Trader Magazine for which she worked as a freelance photogra- Eher. Halbach complained to er manager, Angela M. Schuster, that on previous trips to Avery's property he answered the door wearing only a towel, the affidavit says. In the morning of Oct. 31, Avery called Auto Trader Magazine, represented himself as someone else and requested Halbach come to the salvage yard to photograph a vehicle, the affidavit says.

Willis is expected to rule on the bond modification motion on March 17. Dassey is also scheduled to appear on March 17 for a scheduling conference. Late Wednesday, Green Bay television station WGBA reported that Strang has filed a request for a gag order for Kratz, Calumet County Sheriff Jerry Pagel and their staffs regarding the case.
