and Mrs. John Michael Tuohey. They were killed March 17, 1957, in a flight from St. Louis to Kansas City. Their plane piloted by Tuohey, crashed in adverse weather two miles southeast of Chillicothe, 50 miles off course.

The insurance company contended flying conditions called for an instrument rating that Tuohey did not have. For that reason, the firm argued, it was not liable for coverage in accordance with an exclusion clause in Tuohey's policy. Presiding Judge James W. Broaddus cited depositions by three women residents of Chillicothe who said they saw a flash three or five miles away despite rain and fog. The judge noted the insurance firm's position rested on contention the flight was being conducted in.
