Dr. Doming stated in his complaint that Archer owed him the sum of 8100 and the" latter got back at the physician with a counter claim in which he changed malpractice and asked 81,500 damages because he stated that In consequence of a blunder made by Dr. Doming in performance upon Mrs. Archer of a surgical operation, described in the Complaint, that lady was deprived of all possibility of the happiness of maternity.

The case was set tor trial this morning and Judge neaton thought the taking of the evidence would consume a week. However, when the case was called evidence was first introduced to show that the storks had brought the baby and experts testified that its birth would have been a physical Impossibility had the physician made the mistake chaiged against him. ANNUAL REPORT. Indianapolis, April 18. The annual report of the Lake Erie and Western for the fiscal year ending December 31 shows that the gross earnings were $3,218,728, an Increase of 8919,368. The operating expenses were 83,857,010, an Increase of and the net earnings were 81,360,318, an increase of $8,321. Indianapolis, April 18. There have been no additional deaths from the effect of th flra at St Vincent's hospital yesterday. Several of the patients, who were carried out of the building and who had been operated upon but a few hours before, are in a very serious condition. While the city fire department, re inforoed by companies from the suburbs, was being taxed to its utmost fighting the Occidental hotel fire yesterday morning, an alarm was turned in front St. Vincent's hospital.

When the first fire company arrived one life had been last and several were seriously injured in the panic that followed. The dead: Harriet Leahy, Jumped from the fourth floor and instantly killed. The injured: Miss Kate Beach, believed to be fatally injured by falling from the third floor while trying to escape by means of a rope made of bed clothing. Sister Superior Stella, seriously in jured by shock following a surgical operation. Sister Nordics, seriously injured by shock.

William Schneider, a patient, who at the time of the fire was undergoing an operation. Henry Nichols, Connersville, Just operated upon for appendicitis, ran down stairs. Several ether nurses and attendants were more or less bruised in the endeavor to escape, from what they thought was Instant death. For time it seemed that the' flames, which started among a pile of rugs under the east stairway, would find their way to the upper floors, re suiting in a frightful holocaust. At every window on the third and fourth floors were crowded the panlo stricken men and women, screaming for help to those on the street below, who yore for more than twenty min utes prevented from entering the I building because of the dense smoke.

I The panic that raged on the third and fourth floors continued until long alter me nre naa oeen quencnea. OLD INDIANA BANK HASJEEN CLOSED McCoy's Bank at Renssalaer, Founded 1854, Will Go Into Liquidation. Renssalaer, April 18. A. McCoy's bank failed to open today.

A notice was posted on the door that It was permanently closed and would go into liquidation. It was the oll est banking institution in the county and is owned by Alfred and Thomas McCoy, heavy landowner. I Both are la poor health. It is prom ised that the bank will pay out In full. The bank was a private Institution and was organised in 1804.

By the last statement the capital was $50,000, deposits $250,000 ana loans and discounts $225,000. A. McCoy and his son, Thomas J. McCoy, members of the Republican state committee from the Tenth district, filed voluntary assignments today in tha circuit court. No schedules were filed, but it is estimated the assets are $350,000 and the liabilities A.

prominent official of another bank here said today there is no doubt the depositors of the McCoy bank will be paid in full. He said both father and son are in poor health and the assignment was mada to protect creditors and realize immediately on assets. Thomas J. McCoy is a member of Qavernor Durbin's staff. STRIKE IN SHIPTARD.

Qulncy, Mass, April 18 Work In the extensive yards of the Fore River Ship and Engine compsny here was tied up today by a strike of 2,000 men, over a question of hour. The action of the men stopped work on the battleships Rhode Island, New Jersey and Vermont as well as on large private contracts. Unless ths difficulty is successfully adjusted it is thought the launching of the battleship Rhode Island, set for HOTEL IS BURNED. Indianapolis, April 18. Eire which for almost two hours threat' ened to destroy the principal retail district, was discovered at an early hour Sunday morning in the Occl rdental hotel.

Every firs company in the city, as well as those from the outlying were summoned. The house was filled with guests and a panic was narrowly averted. There were many narrow escapes from the flames and suffocation, the guests be ing compelled to leave the building clad only in their night robes. The hotel, which fronts for half a block on Illinois street, south of Washington, is valued at $100,000, and Is gutted. The loss is estimated at $75,000.

The ruins of the Occidental hotel are being searched for the body of Steven Waters, a colored porter, who is nusslng. He is known to have been intoxloated shortly before the fire and went to his room in the burned portion. Hon. S. S.
